NOTICE OF TRUSTEE’S SALE and Notice of the Beneficiary/Servicer’s election to sell property is hereby given pursuant to and by virtue of the authority vested in the Trustee by that certain Deed of Trust dated February 20, 2004, executed by Thomas N. Veon and Dawn M. Veon to Jenny N. Phillips, Trustee, of record in the Office of the Clerk of the County Commission of Wood County, West Virginia, in Book 1187, at Page 166. Hereford & Riccardi, PLLC was appointed as Trustee by SUBSTITUTION OF TRUSTEE dated April 8, 2015, of record in the Clerk’s Office in Book 1865, at Page 431. The borrowers defaulted under the Note and Deed of Trust and the Trustee has been instructed to foreclose under the Deed of Trust. Accordingly, the Trustee will sell the following described property to the highest bidder at the front door of the Courthouse of Wood County, in Parkersburg, West Virginia, on:

 

WEDNESDAY, AUGUST 10, 2016, AT 1:00 O’CLOCK P.M.

 

All of that certain lot or parcel of land, together with the improvements thereon and the appurtenances thereunto belonging, situate in Williams District, Wood County, West Virginia, and being more particularly bounded and described as follows:

 

BEING all of Lot No. 106 Brierwood Subdivision as shown and described on that certain plat of said Subdivision, which is of record in the Office of the Clerk of the County Commission of Wood County, West Virginia, in Plat Book 16, as page 5, to which plat is of record, reference is hereby made and for a more particular description of said lot.

 

This is the same property conveyed unto Thomas N. Veon and Dawn N. Veon by Deed dated February 16, 2004, of record in the Clerk’s Office in Book 1063, at Page 920.

 

By the acceptance, purchase and ownership of any lot or lots, the owner or owners automatically becomes or become members and subject to the By-laws, rules and regulations of the Brierwood Subdivision Property Owners Association, its successors and assigns, which organization shall be non-profit and for the purpose of improving and maintaining the public roads and streets, recreational areas and common lands of said Subdivision, each lot owner or owners to have one vote per lot.

 

TERMS OF SALE:

1) The property will be conveyed in an âAS ISã physical condition by Deed containing no warranty, express or implied, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights-of-ways, easements, covenants, conveyances and conditions of record in the Clerkás office or affecting the subject property.

2) The Purchaser shall be responsible for the payment of the transfer taxes imposed by the West Virginia Code Œ 11-22-2.

3) Real estate taxes due and payable have been paid.  All real estate taxes hereafter will be the responsibility of the purchaser.

4) The Beneficiary and/or the Servicer of the Deed of Trust and Note reserve the right to submit a bid for the property at sale.

5) The Trustee reserves the right to continue sale of the subject property from time to time by written or oral proclamation, which continuance shall be in the sole discretion of the Trustee.

6) The Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate the property, and any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY.

7) The total purchase price is payable to the Trustee by cashier’s check, cash or the equivalent within thirty (30) days of the date of sale, with ten percent (10%) of the total purchase price payable to the Trustee at sale by cashier’s check, cash or the equivalent. There will be no refund granted of any amount if the third party purchaser elects not to purchase the property for any reason. Minimum acceptable bid will be $27,500.00.

PUBLIC NOTICE OF CHANGE IN RATES UPON

APPLICATION

 

NOTICE is hereby given that Hope Gas, Inc., dba Dominion Hope (the âCompanyã), a public utility, has filed with the PUBLIC SERVICE COMMISSION OF WEST VIRGINIA, an application containing increased rates, tolls and charges for furnishing natural gas service to all of its customers at various locations in the Counties of Barbour, Boone, Braxton, Calhoun, Clay, Doddridge, Gilmer, Harrison, Jackson, Kanawha, Lewis, Lincoln, Logan, Marion, Marshall, Mason, McDowell, Mingo, Monongalia, Nicholas, Pleasants, Preston, Putnam, Raleigh, Randolph, Ritchie, Roane, Taylor, Tucker, Tyler, Upshur, Wetzel, Wirt, Wood and Wyoming.

The proposed increased rates and charges will become effective November 1, 2016, unless otherwise ordered by the Public Service Commission and will increase revenues approximately $4.1 million annually, an increase of 4%.  The average monthly bill for the various classes of customers will be changed as follows:

Resale customers of Dominion Hope include Standard Gas Co., Consumers Gas Utility Co., Lumberport-Shinnston Gas Co., Inc., Mountaineer Gas Co., Southern Public Service Co., Blacksville Oil & Gas Co., Inc., and Peoples Gas WV LLC.

The increases shown are based on averages of all customers in the indicated classes. Each class may receive an increase greater or less than stated here. Individual customers may receive increases that are greater or less than average.  Furthermore, the requested increased rates and charges are only a proposal and are subject to change (increase or decrease) by the Public Service Commission in its review of this filing. Any increase or decrease in rates and charges will not become effective until authorized and approved by the Public Service Commission. (If a hearing is conducted, notice will be given of the time and place of hearing.)

A complete copy of the proposed rates, as well as a representative of the Company to provide any information requested concerning it, is available to all customers, prospective customers, or their agents at the Clarksburg office of the Company, 48 Columbia Boulevard, Clarksburg, West Virginia.

A copy of the proposed rates is available for public inspection at the office of the Executive Secretary of the PUBLIC SERVICE COMMISSION at 201 Brooks Street, Charleston, West Virginia.

The 30-C procedure is designed to provide a procedure for changing rates charged to customers by natural gas distribution utilities based exclusively on the cost of purchased gas. Consequently, protest should be limited to the reasonableness of such costs and the method by which they are calculated. Anyone desiring to protest or intervene should file a written protest or notice of intervention within twenty-five (25) days following the date of this publication unless otherwise modified by Commission order. Failure to timely intervene can affect your rights to protest any rate increases and to participate in future proceedings. Requests to intervene must comply with the Commission’s rules on intervention set forth in the Commission’s Rules of Practice and Procedure. NOTICE is hereby given that MOUNTAINEER GAS COMPANY, a public utility, has filed with the PUBLIC SERVICE COMMISSION OF WEST VIRGINIA, an application containing decreased rates, tolls and charges for furnishing natural gas service to approximately 220,000 customers at various locations in the Counties of Barbour, Berkeley, Boone, Braxton, Brooke, Cabell, Calhoun, Clay, Doddridge, Fayette, Gilmer, Grant, Greenbrier, Hancock, Hardy, Harrison, Jackson, Jefferson, Kanawha, Lewis, Lincoln, Logan, Marion, Marshall, Mason, McDowell, Mercer, Mineral, Mingo, Monongalia, Monroe, Nicholas, Ohio, Pendleton, Preston, Putnam, Raleigh, Randolph, Ritchie, Roane, Summers, Tucker, Tyler, Upshur, Wayne, Wetzel, Wirt, Wood, and Wyoming.

 

The proposed rates and charges will become effective for services rendered on and after November 1, 2016, unless otherwise ordered by the Public Service Commission, and will reduce annual revenue by approximately $7,199,321, a decrease of approximately 6.6%.

 

The average monthly bill for the various classes of customers of MOUNTAINEER GAS COMPANY will be changed as follows:

PUBLIC NOTICE

FEMA-4273-DR-WV

 

The Federal Emergency Management Agency (FEMA) hereby gives notice to the public of its intent to reimburse eligible applicants for eligible costs to repair and/or replace facilities damaged by severe storms, flooding, landslides, and mudslides (FEMA-4273- DR-WV) occurring from June 22, 2016 to June 29, 2016. This notice applies to the Public Assistance (PA), Individual Assistance (IA), and Hazard Mitigation Grant (HMGP) programs implemented under the authority of the Robert T. Stafford Disaster Relief and Emergency Assistance Act, 42 U.S.C. ŒŒ 5121-5206.

 

Under a major disaster declaration (FEMA-4273-DR- WV) signed by the President on June 25, 2016 and amended on July 13, 2016, the following counties have been designated adversely affected by the disaster and eligible for both PA and IA: Braxton, Clay, Fayette, Gilmer, Greenbrier, Jackson, Kanawha, Lewis, Lincoln, Monroe, Nicholas, Pocahontas, Randolph, Roane, Summers, Upshur, Wayne, and Webster counties. Additional counties may be designated at a later date.  All counties in the State of West Virginia are eligible for HMGP.

 

This public notice concerns activities that may affect historic properties, activities that are located in or affect wetland areas or the 100-year floodplain, and critical actions within the 500-year floodplain. Such activities may adversely affect the historic property, floodplain or wetland, or may result in continuing vulnerability to flood damage.

 

Presidential Executive Orders 11988 and 11990 require that all federal actions in or affecting the floodplain or wetlands be reviewed for opportunities to relocate, and evaluated for social, economic, historical, environmental, legal and safety considerations. Where there is no opportunity to relocate, FEMA is required to undertake a detailed review to determine what measures can be taken to minimize future damages. The public is invited to participate in the process of identifying alternatives and analyzing their impacts.

 

FEMA has determined that for certain types of facilities there are normally no alternatives to restoration in the floodplain/wetland. These are facilities that meet all of the following criteria: 1) FEMA’s estimate of the cost of repairs is less than 50% of the cost to replace the entire facility, and is less than $100,000; 2) the facility is not located in a floodway; 3) the facility has not sustained major structural damage in a previous Presidentially declared flooding disaster or emergency;  and 4) the facility is not critical (e.g., the facility is not a hospital, generating plant, emergency operations center, or a facility that contains dangerous materials). FEMA intends to provide assistance for the restoration of these facilities to their pre-disaster condition, except that certain measures to mitigate the effects of future flooding or other hazards may be included in the work. For example, a bridge or culvert restoration may include a larger waterway opening to decrease the risk of future washouts.

 

For routine activities, this will be the only public notice provided. Other activities and those involving facilities that do not meet the four criteria are required to undergo more detailed review, including study of alternate locations.  Subsequent public notices regarding such projects will be published if necessary, as more specific information becomes available.

 

In many cases, an applicant may have started facility restoration before federal involvement. Even if the facility must undergo detailed review and analysis of alternate locations, FEMA will fund eligible restoration at the original location if the facility is functionally dependent on its floodplain location (e.g., bridges and flood control facilities), or the project facilitates an open space use, or the facility is an integral part of a larger network that is impractical or uneconomical to relocate, such as a road. In such cases, FEMA must also examine the possible effects of not restoring the facility, minimize floodplain/wetland impacts, and determine both that an overriding public need for the facility clearly outweighs the Executive Order requirements to avoid the floodplain/wetland, and that the site is the only practicable alternative. State of West Virginia and local officials will confirm to FEMA that proposed actions comply with all applicable State and local floodplain management and wetland protection requirements.

 

FEMA intends to provide IA program funding for disaster-related emergency housing. These actions may adversely affect a floodplain/wetland, or may result in continuing vulnerability to floods. These actions may include repair, restoration or construction of housing or private bridges, purchase and placement of travel trailers or manufactured housing units, or repair of structures as minimum protective measures. This will be the only public notice concerning these actions.

 

FEMA also intends to provide HMGP funding to the State of West Virginia to mitigate future disaster damages. These projects may include construction of new facilities, modification of existing, undamaged facilities, relocation of facilities out of floodplains, demolition of structures, or other types of projects to mitigate future disaster damages. In the course of developing project proposals, subsequent public notices will be published if necessary, as more specific information becomes available.

 

The National Historic Preservation Act requires federal agencies to take into account the effects of their undertakings on historic properties.  Those actions or activities affecting buildings, structures, districts or objects 50 years or older or that affect archeological sites or undisturbed ground will require further review to determine if the property is eligible for listing in the National Register of Historic Places (Register). If the property is determined to be eligible for the Register, and FEMA’s undertaking will adversely affect it, FEMA will provide additional public notices. For historic properties not adversely affected by FEMA’s undertaking, this will be the only public notice.

 

The Rehabilitation Act of 1973 protects the civil rights of persons with disabilities. It prohibits discrimination on the basis of disability by the federal government, federal contractors, and by recipients of federal financial assistance. Any recipient or sub-recipient of federal funds is required to make their programs accessible to individuals with disabilities. Its protections apply to all programs and businesses that receive any federal funds and applies to all elements of physical/architectural, programmatic and communication accessibility in all services and activities conducted by or funded by FEMA. FEMA intends to comply with the Rehabilitation Act in all federally conducted and assisted programs in alignment with the principals of whole community inclusion and universal accessibility.

 

As noted, this may be the only public notice regarding the above-described actions under the PA, IA, and HMGP programs.
