Situate in Parkersburg District, Wood County, West Virginia, being part of Lot Number One (1) in Adairás Addition to the City of Parkersburg, and bounded and described as follows:

Beginning at the point of intersection of the northern line of Blennerhassett Avenue with the western line of North Avery Street, 128.23 feet to a point; thence at right angles and in a western direction 47 feet; thence in a southern direction in a line parallel with the first line 128.23 feet to the line of Blennerhassett Avenue; thence east in the northern line of Blennerhassett Avenue, 47 feet to the place beginning.

At the time of the execution of the Deed of Trust, this property was reported to have an address of: 931 32nd St, Parkersburg, WV 26104.

The referenced real estate will be conveyed with no covenants of warranty, and subject to all covenants, restrictions, easements, rights of way and reservations which may be a matter of record in the aforesaid Clerk’s Office or visible upon the ground, all prior liens and encumbrances, including, without limitation, liens for real estate taxes, incinerator, sanitary and sewer charges. The purchasers at the sale shall be responsible for paying the recording costs and also the tax on the privilege of transferring real property (the cost of the tax stamp to be affixed to the deed). The purchasers shall be responsible for payment of all real estate taxes.

The subject property will be sold in âAS ISã condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.

TERMS: $6000.00 in cash and/or certified funds as deposit at the time of sale with the
balance due and payable within 30 days of the day of sale.

FEDERAL TAX LIEN: In the event that there are Federal Tax Liens against the property, the United States would have the right to redeem the property within a period of 120 days from the date of such sale or the period allowable for redemption under local law, whichever is longer.

Pursuant to the Deed of Trust, the Trustee may postpone the sale by public announcement at the time and place designated or by posting a notice of the same, and act by agent in the execution of the sale. The parties secured by the Deed of Trust reserve the right to purchase the property at such sale.

NOTICE OF APPLICATION TO CHANGE RATES

CASE NO. 19-0470-PSD-19A

On May 3, 2019, the Mineral Wells Public Service District a public utitlity, filed with the Public Service Commission of West Virginia, an application requesting increased rates and charges for furnishing sewer service to approximately 1,761 customers in Wood County.

The Staff of the Public Service Commission has reviewed the application and has recommended increased Step 1 rates and charges designed to produce approximately $86,692 annually in additional revenue, an increase of 7.94% over current rates and increased Step 2 rates and charges designed to produce approximately $44,256 annually in additional revenue, an increase of 4.05% over current rates. Step 2 rates take effect 24 months after implementing Step 1 rates.

The average monthly bill for the various classes of customers would be changed as follows:

The Commission may adopt rates and charges for Mineral Wells Public Service District which are the same as, greater than or less than the Staff-recommended rates and charges.

Anyone desiring to review the Staff recommendation report may do so on the Commission website (www.psc.state.wv.us). Anyone desiring to protest the changed rates and charges must do so, in writing, within ten (10) days of the date of publication of this notice. All protests may be filed online through the Commission website using the âSubmit a Commentã link or may be mailed to the Executive Secretary, Public Service Commission of West Virginia, P.O. Box 812, Charleston, West Virginia 25323 or hand-delivered to the Public Service Commission. To help the Commission determine the justification for additional review and investigation, protests must be specific as to reasons that the changed rates and charges should be modified. In addition, anyone desiring a hearing in this matter must demand a hearing in the written protest.

If no hearing is demanded, the Commission may affirm the proposed rates without a hearing.

Michael Simpson has defaulted under the terms of the Promissory Note secured by the Deed of Trust. The debt evidenced by the Promissory Note has therefore been accelerated by the lender, WesBanco Bank, Inc.

SECOND TRACT: BEGINNING at a point in the southerly line of Thirty-Seventh Street, which said point is the common line between Lots 39 and 40 of R. R. DeBusseyás Addition, as shown on the plat of said Addition, of record in the Office of the Clerk of the County Commission of Wood County, West Virginia, in Plat book 7, at page 24; thence with southerly line of Thirty-Seventh Street, in an easterly direction five (5) feet; thence in a southerly direction, and in line parallel with said common line between said Lots 39 and 40 of said Addition, 115.65 feet to the southerly line of said Lot 40 of said Addition; thence in a westerly direction along the southerly line of said Lot 40, 5 feet to the aforesaid common line between Lots 39 and 40 of said Addition; thence with said common line between said lots , in a northerly direction, 115.65 feet to the place of beginning.

PRIOR DEED REFERENCE: Deed Book 1895, at page 552.

This conveyance is made subject to all easements, rights of way, restrictions, reservations and protective covenants, including but not limited to all oil, gas and mineral exceptions, reservations and leases, appearing in the chain of title.

The above-described property is reported to have a mailing address of or is commonly known as: 1704 37th Street, Parkersburg, West Virginia 2610 1.
The real estate will be sold subject to real estate taxes assessed against the real estate, zoning regulations, prior Deeds of Trust, judgment liens, leases, including, but not limited to, oil, gas, and mineral leases, restrictions, rights-of-way, reservations, protective covenants, delinquent fees, rates and charges of any public service district, recorded or unrecorded, public utility easements and easements of record affecting the real estate.
