Pursuant to the authority vested in the undersigned by deed of trust dated the 1st day of March 2006, signed by Margaret G. TERMS OF SALE: Cash in hand on day of sale or within 30 days of date of sale upon terms to be agreed upon between Trustee and successful bidder, time being of the essence; payment for unpaid real estate taxes to be assumed by the purchaser. The Trustee does not warrant title or fitness to this property; it is being purchased as is; this is a buyer beware sale and any buyer is advised to retain counsel before the sale. If there is any part of the process of sale which is found to be objectionable, the Trustee reserves the right to cancel the sale. These notices shall satisfy two separate but related procedural requirements for activities to be undertaken by the City of Parkersburg.

 

REQUEST FOR RELEASE OF FUNDS

 

On or about January 9, 2018 the City of Parkersburg will submit a request to the U.S. Housing &Urban Development for the release of Community Development Block Grant (Section 108) funds under Title 1 of The Housing and Community Development Act of 1974, as amended, to undertake a project known as 16th & Covert Fire Station for the purpose of using Community Development Grant (CDBG) Program funds, leveraged through a U.S. Housing and Urban Development Section 108 Loan to demolish a fire station and construct a new fire station. Section 108 loans provide units of local government access to low interest rate financing for a number of different projects. The cost of this project would far exceed the capital available from the Cityás general fund. In addition to the demolition of the current fire station #2, the City must acquire and demolish 1504 Covert Street, an adjoining piece of property necessary to accommodate an expanded footprint of the new facility.

 

FINDING OF NO SIGNIFICANT IMPACT

 

The City of Parkersburg has determined that the project will have no significant impact on the human environment. Therefore, an Environmental Impact Statement under the National Environmental Policy Act of 1969 (NEPA) is not required. Additional project information is contained in the Environmental Review Record (ERR) on file at the City of Parkersburg Development Department, Fifth Floor of the Municipal Building. One Government Square, Parkersburg, WV 26102. and may be examined or copied weekdays 8:00A.M to 4:00P.M.

 

PUBLIC COMMENTS

 

Any individual, group, or agency may submit written comments on the ERR to Ryan Barber, Development Projects Administrator. All comments received by January 9, 2018 will be considered by the City of Parkersburg prior to authorizing submission of a request for release of funds. Comments should specify which Notice they are addressing.

 

ENVIRONMENTAL CERTIFICATION

 

The City of Parkersburg certifies to HUD that Tom Joyce in his capacity as Parkersburg City Mayor consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied. HUD’s approval of the certification satisfies its responsibilities under NEPA and related laws and authorities and allows the City of Parkersburg to use Program funds.

HUD will accept objections to its release of fund and the City of Parkersburg’s certification for a period of fifteen days following the anticipated submission date or its actual receipt of the request (whichever is later) only if they are on one of the following bases: (a) the certification was not executed by the Certifying Officer of the City of Parkersburg; (b) the City of Parkersburg has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR part 58; (c) the grant recipient or other participants in the development process have committed funds, incurred costs or undertaken activities not authorized by 24 CFR Part 58 before approval of a release of funds by HUD; or (d) another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality. Objections must be prepared and submitted in accordance with the required procedures (24 CFR Part 58, Sec. 58.76) and shall be addressed to HUD/Pittsburgh Field office at William Moorhead Federal Building 1000 Liberty Avenue, Suite 1000.
