Notice Notice is hereby given that the Council of the City of Williamstown, West Virginia, will, on the 2nd day of January 2018, at 7:30 p.m. at the Williamstown City Building, located at 100 West Fourth Street, Williamstown, West Virginia, consider for adoption a Resolution approving a Right-of-Way Use Agreement between the City of Williamstown and Lumos Networks of West Virginia, Inc., the purpose of which said Right-of-Way Use Agreement is to grant to Lumos Networks of West Virginia, Inc. a non-exclusive franchise for the construction, installation, maintenance and operation of certain facilities including wires, fiber optic cables, conduits, converters, splice boxes, cabinets, handholds, manholes, vaults, equipment, drains, surface location markers, and appurtenances in or upon Rights-of-Way of the City of Williamstown. Any persons seeking to comment upon the adoption of said Resolution is entitled to be present and be heard at the time and place set forth above. TERMS OF SALE:

 

1) The property will be conveyed in an âAS ISã physical condition by Deed containing no warranty, express or implied, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights-of-ways, easements, covenants, conveyances and conditions of record in the Clerkás office or affecting the subject property.

2) The Purchaser shall be responsible for the payment of the transfer taxes imposed by the West Virginia Code Œ 11-22-1.

3) The Beneficiary and/or the Servicer of the Deed of Trust and Note reserve the right to submit a bid for the property at sale.

4) The Trustee reserves the right to continue sale of the subject property from time to time by written or oral proclamation, which continuance shall be in the sole discretion of the Trustee.

Notice is hereby given that default has occurred in the payment of that certain indebtedness secured by a Deed of Trust executed December 14, 2006, of record in the Office of the Clerk of the County Commission of Wood County, West Virginia, in Trust Deed Book 1402, at page 35 (the âDeed of Trustã), made by 786 Hospitality Group, LLC (ãGrantorã), to Barry W. There is expressly reserved unto Wiley H. Hicks and Elouise C. TERMS OF SALE:

 

Sale of the Real Estate will be made by the Trustee by public auction to the highest bidder. The Trustee reserves the right to reject any bid that in opinion is inadequate. Notice is hereby given that on December 18, 2017, a public hearing, as required by Section 147(f) of the Internal Revenue Code of 1986, as amended (the âCodeã), will be held by the Board of County Commissioners of Wood County, West Virginia (the âCountyã) with respect to the proposed issuance by the Public Finance Authority of the State of Wisconsin (the âAuthorityã) of its Revenue Bonds, Series 2017A (ACE Educational Foundation, Inc. Project) in one or more series (the âBondsã), in an amount not to exceed $5,500,000. The following information was provided by the Authority for this Notice:

 

  1. The Bonds are expected to be issued pursuant to Section 66.0304 of the Wisconsin Statutes, as amended, by the Authority, a commission organized under and pursuant to the provisions of Sections 66.0301, 66.0303 and 66.0304 of the Wisconsin Statutes, as amended.

 

  1. The proceeds from the sale of the Bonds will be loaned to the Borrower identified below and used for the Project identified below.

 

  1. The Bonds will be limited obligations of the Authority payable solely from the loan repayments to be made by the Borrower to the Authority, and certain funds and accounts established by a financing agreement for the Bonds.

 

The following information was provided by ACE Educational Foundation, Inc., a New York nonprofit corporation (the âBorrowerã), for this Notice:

 

  1. The Borrower will use the proceeds of the Bonds to (i) acquire a gasifier license from Ohio Valley University; (ii) acquire approximately 60 acres of land at 120 29th Street, in Parkersburg, West Virginia; (iii) pay predevelopment, engineering, design and consulting costs relating to a planned coal gasification plant and educational facility for production and management of clean energy on the Site; and (iv) pay the costs of issuance of the Bonds (collectively, the âProjectã).

 

  1. The Project will initially be owned and operated by the Borrower and/or its wholly owned subsidiary.

 

The hearing will provide a reasonable opportunity to be heard for persons wishing to express their views on the merits of the Project, its location, the issuance of the Bonds or related matters. (a) There is hereby imposed upon the respective owners of all buildings in the City an annual fire protection fee for each fiscal year, in an amount equal to the total number of square feet contained in the building multiplied by 0.08775 cents

(b) There is hereby imposed upon the respective owners of all buildings in the City containing three or more stories an additional annual fire protection fee for each fiscal year, the sum of one hundred ninety-five dollars ($195 00) for the third story and each story in addition thereto.

Bidding documents and specifications are available at the office of the Public Works Director, Vienna Utility Board Building, 210 60th Street, Vienna, WV 26105.

 

Sealed proposals will be received until 9:00 AM on Monday, December 18, 2017, at the above address, at which time they will be publicly opened and read aloud. No bid may be withdrawn after that time for a period of ninety (90) days.

 

Proposals received after that time will not be accepted and will be returned to the bidder unopened. Sealed proposals should be clearly marked âSEALED BID ST18-06ã.

 

Prospective bidders may contact Craig Metz at (304) 295-4543, between the hours of 8:00 AM to 4:00 PM, Monday through Friday, for additional information regarding the bid specifications. Vendors must be registered with the State of West Virginia.
