PUBLIC NOTICE OF PROPOSED ORDINANCE

RELATING TO CITY OF VIENNA’S

WATER RATES, FEES AND CHARGES

 

Notice is hereby given that on the 28th day of September, 2017, the City Council of the City of Vienna caused to be read an Ordinance proposing an increase in its water rates, fees and charges in lieu of its present water rates and charges for service provided to customers of its water system and is proposing the adoption of the same. The proposed Ordinance reads as follows:

 

AN ORDINANCE ESTABLISHING AND FIXING RATES,

FEES AND CHARGES OF THE CITY OF VIENNA, WEST VIRGINIA

WATER SYSTEM

 

WHEREAS, in order to provide revenues sufficient revenues for the City of Vienna to pay the daily expenses associated with the operation of its water system, to provide working capital reserves as required by Chapter 24 of the West Virginia Code, and to provide sufficient revenues to cover the costs associated with renewals and replacements and associated debt service, the City Council of the City of Vienna deems it advisable and necessary to increase the City’s current rates, fees and charges for furnishing water service.

WHEREAS, the City Council finds that the rates, fees and charges set forth below are just and equitable for the service provided to the City’s water customers and that such rates will be sufficient to meet daily expenses associated with the operation of its water system, to provide working capital reserves as required by Chapter 24 of the West Virginia Code, and to provide funding of its associated debt service.

NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF VIENNA HEREBY ORDAINS that the following rates, fees and charges shall be adopted and placed into effect in lieu of its Water Tariff No. 8 currently on file with the Public Service Commission of West Virginia:

 

RULES AND REGULATIONS

 

The Rules and Regulations as set forth in current Water Tariff No. 8 shall remain unchanged.

MINIMUM CHARGE

No bill will be rendered for less than the customer charge.

 

RESALE RATE

$1.80 per 1,000 gallons used per month plus customer charge

 

PRIVATE FIRE PROTECTION

4             inch connection                                $10.00 per month

6             inch connection                                  15.00 per month

8             inch connection                                  20.00 per month

 

LEAK ADJUSTMENT INCREMENT PRODUCED

$1.00 per M. Gallon to be used when the bill reflects unusual consumption which can be attributed to leakage on the customer’s side of the meter.  This rate is used to calculate consumption above the customer’s historical average usage.

 

DELAYED PAYMENT PENALTY

The above tariff is net.  On all current usage billings not paid in full within twenty (20) days, ten (10%) percent will be added to the net current amount unpaid. This delayed payment penalty is not interest and is to be collected only once for each bill where it is appropriate.

 

SERVICE CONNECTION CHARGE

A charge of three hundred dollars ($300.00), or the actual cost of the connection (solely determined by the utility), whichever is greater, shall be made for each new connection to the water system.

 

SECURITY DEPOSIT

All new applicants for residential or other water service may be required to deposit (1) a minimum of fifty dollars ($50.00) or (ii) two-twelfths (2/12) of the annual estimated charge for water service, whichever is greater.

 

All new applications for residential or other combined water and sewer service may be required to deposit (1) a minimum of one hundred dollars ($100.00), or (ii) two-twelfths (2/12) of the annual estimated charge for each service, whichever is greater.

 

WATER DISCONNECT-RECONNECT-ADMINISTRATIVE FEES

Whenever water service has been disconnected for non-payment of water bills, a disconnection fee of $25.00 shall be charged; or in the event the delinquent water bill is collected in the field, an administrative fee of $25.00 shall be charged. Whenever water service which has previously been disconnected or otherwise withheld for non-payment of a water bill or by request, is reconnected, a reconnection fee of $25.00 shall be charged.

 

RETURNED CHECK CHARGE

A service charge of $25.00 will be imposed upon any customer whose check for payment of charges is returned by the bank for any reason.

 

SECTION 2. EFFECTIVE DATE

 

The rates, fees and charges as set forth above shall become effective shall become effective 45 days after the enactment hereof.

 

SECTION 3. SEPARABILITY; REPEAL OF CONFLICTING ORDINANCES

 

The provisions of this Ordinance are separable, and if any clause, provision or section hereof be held void or unenforceable by any court of competent jurisdiction, such holding shall not affect the remainder of this Ordinance.  Upon the effective date of the charges herein set forth, all ordinances, resolutions, orders or parts thereof in conflict with the provisions of this Ordinance are, to the extent that the provisions of this Ordinance do not touch upon the provisions of prior ordinances, resolutions, orders or parts thereof, the same shall remain in full force and effect.

 

SECTION 4. STATUTORY NOTICE AND PUBLIC HEARING

 

Upon introduction hereof, the City Clerk shall publish public notice of this Ordinance as a Class II legal advertisement in The Parkersburg News and Sentinel, being the only newspaper published and of general circulation in Wood County, West Virginia, and being of general circulation in the City of Vienna, and said notice shall state that this Ordinance has been introduced, and that any person interested may appear before Council on the 26th day of October, 2017, at 7:00 p.m., which date is not less than 10 days subsequent to the date of the first publication of notice of this Ordinance, and present protests. At such hearing all objections and suggestions shall be heard and the Council shall take such action as it shall deem proper on the premises.  Further, said Notice shall advise the public that a copy of this ordinance is available for public inspection at City Hall.

(Equivalent to 2,000 gallons of water usage)

Equivalent of 4,500 gallons of water usage

 

DELAYED PAYMENT PENALTY

The above schedule is net. On all accounts not paid in full when due, ten percent will be added to the net current amount unpaid. This delayed payment penalty is not interest and is to be collected only once for each bill where it is appropriate.

 

TAP FEE

The following charges are to be made whenever the utility installs a new tap to serve an applicant.

 

A tap fee of $100.00 will be charged to customers applying for service before construction is completed adjacent to the customer’s premises in connection with a certificate proceeding before the Commission. This pre-construction tap fee will be invalid after the completion of construction adjacent to the applicant’s premises that is associated with a certificate proceeding.

 

A tap fee of $350.00 will be charged to all customers who apply for service outside of a certificate proceeding before the Commission for each new tap to the system.

 

Whenever a road bore is necessary, cost will be increased depending upon amount of footage, cost of materials and labor. Sewer Department will go to property line or 50 feet, whichever is less.

 

WATER DISCONNECT-RECONNECT-ADMINISTRATIVE FEES

An antidegradation review was performed. Tier 1 protection is afforded for the uses specified in Title 47, Series 2, Section 6. Also, to incorporate the requirements relative to Title 33, Series 2 of the West Virginia Legislative Rules for the processing and disposal of sewage sludge generated by the wastewater treatment plant. Sewage sludge generated and/or processed at the permitteeás facility shall be disposed of at a sanitary landfill by placing the sewage sludge in the landfill cell.

Also, to acquire, construct, install, operate and maintain a line extension project to the existing sewage collection system and an upgrade/retrofit of the existing WWTP including replacement of the UV disinfection system, new telemetry, permanent generator and other minor improvements.

NOTICE IS HEREBY GIVEN, that THE BUILDING COMMISSION OF WOOD COUNTY, a public corporation and county building commission of the State of West Virginia (the âIssuerã or the âBuilding Commissionã) contemplates the enactment of an ordinance (the âOrdinanceã) at a special meeting to be held on Thursday, October 19, 2017, at 11:30 a.m., prevailing time, to consider for approval the issuance by the Building Commission of its Wood County Building Commission Lease Revenue Refunding Bonds, Series 2017 (Bank Qualified ­ Tax Exempt) (the âRefunding Bondsã) pursuant to Chapter 8, Article 33, Chapter 8, Article 16 and Chapter 13, Article 2E of the Code of West Virginia, 1931, as amended (collectively, the âActã) for the purposes of (i) refunding all or a portion of the Taxable Lease Revenue Bonds, Series 2010 A (Recovery Zone Economic Development Bonds) (the âBonds to be Refundedã), and (ii) paying costs of issuance relating thereto. The Ordinance further provides for the continued leasing by the Building Commission of the property financed in whole or in part by the Bonds to be Refunded and certain adjacent properties (sometimes referred to as the Judicial Center and hereinafter collectively referred to as the âPropertyã or the âFacilitiesã) to The County Commission of Wood County, a public corporation and political subdivision of the State of West Virginia (the âCounty Commissionã), pursuant to that certain Lease Agreement by and between the Building Commission as lessor and the County Commission as lessee, entered into in connection with the original issuance of the Bonds to be Refunded (the âOriginal Leaseã), as such Original Lease is proposed to be amended and supplemented by a Supplemental Lease Agreement (the âSupplemental Lease Agreementã). The Original Lease, as so amended and supplemented by the Supplemental Lease Agreement is hereinafter referred to as the âLease.ã

The Refunding Bonds shall not constitute an indebtedness of the Building Commission or the County Commission, but shall be special obligations of the Building Commission payable solely from the revenues, rentals, and other monies received by the Building Commission pursuant to the Lease and any other permitted lease of the Facilities, other security including funds and accounts pledged to such repayment pursuant to the Trust Indenture described below, and the real and personal property constituting the Project pursuant to a Credit Line Deed of Trust, Fixture Filing and Security Agreement, (collectively, the âOriginal Deed of Trustã) by and among the Building Commission, the trustees named therein, and United Bank, Inc., as bond trustee, which shall be modified, supplemented and amended by a modification to the Original Deed of Trust, to be executed in connection with the proposed issuance of the Refunding Bonds (the âOriginal Deed of Trust, as so modified, supplemented and amended, is hereinafter referred to as the âDeed of Trustã). The Refunding Bonds, together with the interest thereon, shall never be nor constitute a charge against the general credit or taxing powers of the Building Commission, the County Commission, or Wood County, nor shall the same ever constitute an indebtedness of the Building Commission, the County Commission or Wood County within the meaning of any constitutional provision or statutory limitations.

The Ordinance further provides for one or more supplements (including specifically a Supplemental Trust Indenture that is a supplement) to the original Trust Indenture between the Building Commission and United Bank, Inc., as Trustee (the âOriginal Trust Indentureã, and as so supplemented by the Supplemental Trust Indenture, collectively, the âTrust Indentureã). The Building Commission will deliver the Refunding Bonds in return for the purchase price thereof to be used to refund all or a portion of the Bonds to be Refunded. As noted above, and as further provided in the Ordinance, the Facilities will initially continue to be leased by the Building Commission to the County Commission of Wood County, West Virginia, pursuant to the Lease.

A public hearing will be held on the Ordinance, the title of which is set forth below, and on the issuance of the Refunding Bonds, and the continued leasing of the Facilities by the Building Commission to the County Commission pursuant to the Lease, before the members of the Building Commission at the County Commission Meeting Room of the Wood County Courthouse, No. 1 Court Square, Suite 203, Parkersburg, West Virginia, on Thursday, October 19, 2017, at 11:30 a.m., prevailing time, and any person or persons interested may appear before the Building Commission to present written or oral protests, comments and suggestions and be heard as to the proposed issue of Refunding Bonds, the acquisition, construction and equipping of the Project, the leasing of the Project facilities by the Building Commission to the County Commission, and as to whether or not the Ordinance shall be put into effect:

These notices shall satisfy two separate but related procedural requirements for activities to be undertaken by the City of Parkersburg.

 

REQUEST FOR RELEASE OF FUNDS

 

On or about October 20, 2017 the City of Parkersburg will submit a request to the U.S. Housing &Urban Development for the release of The HOME Investment Partnerships Program (HOME) funds under Title 1 of The Housing and Community Development Act of 1974, as amended, to undertake a project known as Rayon Elderly Housing for the purpose of acquiring property at 1508 Drive and demolition of the former Rayon Elementary School to construct a 40 unit senior household apartment complex. The housing development will be located at 1508 Rayon Drive Parkersburg, WV. The apartments will serve seniors who are at or below 60% of the area median income. $100,000 will be provided to the non-profit developer, Neighborhood Development Services for their roughly $7,000,000 investment.

 

FINDING OF NO SIGNIFICANT IMPACT

 

The City of Parkersburg has determined that the project will have no significant impact on the human environment.  Therefore, an Environmental Impact Statement under the National Environmental Policy Act of 1969 (NEPA) is not required.  Additional project information is contained in the Environmental Review Record (ERR) on file at the City of Parkersburg Development Department, Fifth Floor of the Municipal Building. One Government Square, Parkersburg, WV 26102. and may be examined or copied weekdays 8:00A.M to 4:00P.M.

 

PUBLIC COMMENTS

 

Any individual, group, or agency may submit written comments on the ERR to Ryan Barber, Development Projects Administrator. All comments received by October 20, 2017 will be considered by the City of Parkersburg prior to authorizing submission of a request for release of funds. Comments should specify which Notice they are addressing.

 

ENVIRONMENTAL CERTIFICATION

 

The City of Parkersburg certifies to HUD that Tom Joyce in his capacity as Parkersburg City Mayor consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied. HUD’s approval of the certification satisfies its responsibilities under NEPA and related laws and authorities and allows the City of Parkersburg to use Program funds.

 

OBJECTIONS TO RELEASE OF FUNDS

 

HUD will accept objections to its release of fund and the City of Parkersburg’s certification for a period of fifteen days following the anticipated submission date or its actual receipt of the request (whichever is later) only if they are on one of the following bases: (a) the certification was not executed by the Certifying Officer of the City of Parkersburg; (b) the City of Parkersburg has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR part 58; (c) the grant recipient or other participants in the development process have committed funds, incurred costs or undertaken activities not authorized by 24 CFR Part 58 before approval of a release of funds by HUD; or (d) another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality. Objections must be prepared and submitted in accordance with the required procedures (24 CFR Part 58, Sec. 58.76) and shall be addressed to HUD/Pittsburgh Field office at William Moorhead Federal Building 1000 Liberty Avenue, Suite 1000. Pittsburgh, PA 15222-4004. Potential objectors should contact HUD/Pittsburgh Field office to verify the actual last day of the objection period.

TERMS OF SALE:

 

1) The property will be conveyed in an âAS ISã physical condition by Deed containing no warranty, express or implied, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights-of-ways, easements, covenants, conveyances and conditions of record in the Clerkás office or affecting the subject property.

2) The Purchaser shall be responsible for the payment of the transfer taxes imposed by the West Virginia Code Œ 11-22-1.

3) The Beneficiary and/or the Servicer of the Deed of Trust and Note reserve the right to submit a bid for the property at sale.

4) The Trustee reserves the right to continue sale of the subject property from time to time by written or oral proclamation, which continuance shall be in the sole discretion of the Trustee.

5) The Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, and any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY.
