NOTICE IS HEREBY GIVEN that, default having been made in the payment of the indebtedness secured by the deed of trust hereinafter described, and the undersigned having been required so to do by the owner and holder of said indebtedness, the undersigned Substitute Trustee {see General Lien Book No. 2123, at page 864 thereof} will offer for sale at the front door of the Wood County Courthouse, Parkersburg, West Virginia, on

BEGINNING at the southwesterly corner of the intersection of Jackson Avenue and Columbia Street and at the northeasterly corner of Lot No. 16 of J.M. Jackson Addition, as shown on the plat of said Addition of record in the Office of the Clerk of the County Commission of Wood County, West Virginia, in Plat Book No. 2, at page 29, and thence westerly with the southerly line of Jackson Avenue, 59.5 feet to a point; thence at right angles and in a southerly direction 100 feet to the northerly line of an alley; thence with the northerly line of said alley in an easterly direction, 60.52 feet to the westerly line of Columbia Street; and thence with the westerly line of Columbia Street in a northerly direction 100 feet to the place of beginning, being all of Lot No. 16 and the easterly 15.8 feet of Lot No. 15 of J.M. Jackson Addition.

AND believed to have a street address of 998 Jackson Avenue, Parkersburg, West Virginia.
The following terms will apply to said sale, to-wit:
1. Cash in hand on day of sale, or as the Trustee may otherwise agree.
2. Minimum acceptable bid is $47,000.00. The sum of $1,000.00 by Bank or Cashier’s check must be delivered at the sale to the Trustee by the successful bidder.
3. Subject to any and all reservations, exceptions, conditions, grants of rights of way and easements made by the grantors and their predecessors in title prior to the granting of the deed of trust being foreclosed upon.
4. The undersigned reserves the right to adjourn the sale from day to day and time to time upon oral proclamation made at the time and place of sale set forth herein or at such later time and place to which the sale has theretofore been adjourned.
5. The undersigned reserves the right to reject any and all bids.
6. Sale is subject to unpaid ad valorem taxes and special assessments, if any, as well as any sale of the subject real estate for unpaid taxes.
7. The premises described hereinabove, including any and all improvements thereto, are sold “AS IS-WHERE IS” with no warranty express or implied.
8. The owner and holder of the indebtedness secured by the deed of trust described hereinabove reserves the right to bid at this sale.
9. The successful buyer at the sale will be responsible for paying any and all transfer stamps, excise fees and recording costs with respect to the trustee’s deed.
10. Neither the owner and holder of the indebtedness secured by the underlying deed of trust nor the substitute trustee shall have any duty to cause any existing tenant or person or persons occupying the subject property to vacate said property.
11. Any personal belongings remaining in the subject premises after sale shall be deemed abandoned and may thereafter be disposed of at the successful bidder’s or bidders’ discretion. Any person or entity claiming ownership of or any interest in any such property should contact the undersigned prior to sale about any such claim.
12. The successful bidder at the sale and the Trustee shall execute a Memorandum of Sale at the conclusion of the sale, and the terms of the Memorandum shall control.
13. Sale is subject to the provisions of W.Va. Code §38-1-16 regarding any existing tenancy at the subject premises.
14. In the event that the successful bidder at the sale fails or refuses to consummate his, her, its or their purchase, then the Trustee shall have the option to consummate sale with the next highest bidder at the sale.

GENERAL WV/NPDES WATER
POLLUTION CONTROL PERMIT
FOR SMALL DOMESTIC SEWAGE DISPOSAL
SYSTEMS IN WV

The Division of Water and Waste Management is proposing to reissue a General WV/NPDES Water Pollution Control Permit to regulate discharges from domestic sewage disposal systems which have flows of 50,000 GPD or less, except those serving individual residences. The General Permit will authorize the installation, operation and maintenance of domestic sewage disposal systems, or parts thereof, and the direct or indirect discharge of treated wastewater to the waters of the state. It is proposed that this General Permit be issued for a five (5) year term.

Described below are some important aspects of the General Permit Program.

1. Approximately 775 existing facilities are eligible for regulation under this general permit.

2. All eligible existing facilities will be required to complete the general permit registration procedures before receiving coverage under this permit. The DWWM will establish a treatment category and a maximum daily flow prior to authorizing general permit coverage. The current general permit expires September 30, 2020. However, it will be extended through March 31, 2021 to provide continued coverage during the reissuance process.

3. Proposed facilities are also eligible for general permit coverage. However, a Bureau for Public Health approval of construction shall be obtained. Each proposed facility shall meet the public notice and public comment requirements prior to gaining coverage under the general permit. The DWWM shall establish a treatment category and a maximum daily flow prior to authorizing general permit coverage. Facilities proposing a new or expanded discharge (above current design flow) within the Chesapeake Bay drainage area must obtain an individual permit.  This applies to discharges located in the following counties: Berkeley; Grant; Hampshire; Hardy; Jefferson; Mineral; Morgan and Pendleton.  Also, part of eastern Preston and a small section of Tucker (north of Thomas) are included.

4. Those permittees holding existing individual WV/NPDES permits may continue to operate under their individual permit until its expiration date. At that time, coverage under the General Permit will be required.

5. The Director of the DWWM retains authority to require any owner/operator to apply for and obtain an individual permit. This authority will be exercised when the Director determines that such individual permit will better protect the receiving water.

The draft permit and fact sheet may be inspected by appointment between 8 a.m. and 4 p.m., Monday through Friday at the Department of Environmental Protection, Public Information Office, 601 57th Street, S.E., Charleston, WV 25304. Copies of the document may be obtained at a nominal cost.

APPLICATION REGARDING CREATION OF
THE CITY OF VIENNA REDEVELOPMENT DISTRICT NO. 1 AND
APPROVAL OF VIENNA GRAND CENTRAL REDEVELOPMENT PROJECT

A public hearing will be held at a meeting of the City Council of the City of Vienna (the “City Council”), on Thursday, August 20, 2020, at 7:00 p.m., prevailing time, in the Council Chambers at the City Building, located at 609 29th Street, Vienna, West Virginia 26105, and at such hearing any person interested may appear before the City Council and present comments, protests and suggestions. All comments, protests and suggestions shall be heard by the City Council and it shall then take such actions as it shall deem proper in the premises regarding the approval, pursuant to Chapter 7, Article 11B of the Code of West Virginia, 1931, as amended (the “Tax Increment Financing Act”), of an application regarding the creation of a redevelopment district to be designated as the “City of Vienna Redevelopment District No. 1” (the “TIF District”) in the City of Vienna, Wood County, West Virginia, and a project plan pertaining to reimbursing Grand Central Parkersburg LLC (the “Developer”) on a pay-as-you-go basis for (i) certain costs associated with the redevelopment of the former Sears box at Grand Central Mall, particularly demolition, remediation and preparation of the site for redevelopment by the Developer; and (ii) paying administrative, legal, accounting, and professional costs related to the aforementioned, which is to be designated as the “Vienna Grand Central Redevelopment Project” (the “Project”). Following is a brief summary of such matters.

Creation of Redevelopment District
The proposed TIF District includes the real property and certain personal properties comprising parcel 10-46-1 of the Wood County Tax Map, Vienna Tax District, commonly known as the Grand Central Mall in Vienna, West Virginia. The proposed boundaries of the TIF District are those of parcel 10-46-1 of the Wood County Tax Map, Vienna Tax District, as shown on the map set forth below:

Approval of Project Plan
The City of Vienna proposes a project consisting of reimbursing the Developer on a pay-as-you-go basis for (i) certain costs associated with the redevelopment of the former Sears box at Grand Central Mall, particularly demolition, remediation and preparation of the site for redevelopment by the Developer; and (ii) paying administrative, legal, accounting, and professional costs related to the aforementioned, which is to be designated as the “Vienna Grand Central Redevelopment Project,” which will be within the TIF District.

NOTICE is hereby given that MOUNTAINEER GAS COMPANY, a public utility, has filed with the PUBLIC SERVICE COMMISSION OF WEST VIRGINIA, an application containing decreased rates, tolls and charges for furnishing natural gas service to approximately 220,000 customers at various locations in the Counties of Barbour, Berkeley, Boone, Braxton, Brooke, Cabell, Calhoun, Clay, Doddridge, Fayette, Gilmer, Grant, Greenbrier, Hancock, Hardy, Harrison, Jackson, Jefferson, Kanawha, Lewis, Lincoln, Logan, Marion, Marshall, Mason, McDowell, Mercer, Mineral, Mingo, Monongalia, Monroe, Morgan, Nicholas, Ohio, Pendleton, Preston, Putnam, Raleigh, Randolph, Ritchie, Roane, Summers, Tucker, Tyler, Upshur, Wayne, Wetzel, Wirt, Wood, and Wyoming.

The proposed decreased rates and charges will become effective November 1, 2020, unless otherwise ordered by the Public Service Commission, and will reduce revenue approximately $4,405,312 annually, a reduction of approximately 4.5%.

The average monthly bill for the various classes of customers of MOUNTAINEER GAS COMPANY will be changed as follows:

The decreases shown are based on averages of all customers in the indicated class. Each class may receive a decrease greater or less than stated here. Individual customers may receive decreases that are greater or less than average. Furthermore, the requested decreased rates and charges are only a proposal and are subject to change (increases or decreases) by the Public Service Commission in its review of this filing. Any decrease in rates and charges will not become effective until authorized and approved by the Public Service Commission. If a hearing is conducted, notice will be given of the time and place of hearing.

THE CITY OF PARKERSBURG URBAN RENEWAL AUTHORITY WILL CONDUCT A PUBLIC HEARING ON TUESDAY, SEPTEMBER 8, 2020, IMMEDIATELY FOLLOWING CITY COUNCIL AT 7:30 PM IN THE SECOND FLOOR COUNCIL CHAMBERS OF THE MUNICIPAL BUILDING, ONE GOVERNMENT SQUARE, PARKERSBURG, WEST VIRGINIA.
