The undersigned Substitute Trustee, by virtue of the authority vested in him by that certain Deed of Trust, dated March 31, 2011, and duly recorded in the Office of the Clerk of the County Commission of Wood County, West Virginia, in Document No. 682088, in Book No. 1645, at Page 857, and modified in Document No. 746481, in Book No. 1706, at Page 564, Mark D Sheppard did convey unto Scott A. Morehardt and Margery J. Morehardt, husband and wife, by Richard Wilhelm; Jr. and Kathryn L. Wilhelm, husband and wife, by deed dated August 5, 1968, of record in the aforesaid Clerkás Office in Deed Book 555, at page 91.
PARCEL TWO: Being Lot No. 49 C as shown on a plat of the Division of Lot No. 49 of Oakwood Estates, prepared by Paul E. Marshall, surveyor, dated August 25, 1972, a copy of which said plat is attached to that certain deed from Richard Wilhelm, Jr., et ux, to Robert C. Morehardt, et ux., dated August 28, 1972, of record in the Office of the Clerk of the County Court of Wood County, West Virginia, in Deed Book 605, page 399, and reference to said plat is hereby made for a more particular description of the real estate herein conveyed, a plat of Oakwood Estates being of record in the aforesaid Clerkás Office in àPlat book 14, page 41; and being the same real estate conveyed to Robert C. Morehardt and Margery L Morehardt, husband and wife, by deed dated August 28, 1972, of record as aforesaid.
This conveyance is made
subject to all covenants, building restrictions, reservations and rights of way contained in that certain deed dated October 27, 1967, executed by Richard Wilhelm, Jr, and Kathryn Wilhelm, husband and wife, to Jack Headley and Mildred L. Headley, husband and wife, of record in the aforesaid Clerkás office in Deed Book 552, page 218, which said covenants, reservations and restrictions are incorporated herein by reference.
This conveyance is made subject to all covenants, building restrictions, reservations and rights of way contained in that certain deed dated October 27, 1967, executed by Richard Wilhelm, Jr. and Kathryn Wilhelm, husband and wife, to Jack Headley and Mildred L. Headley, husband and wife, of record in the aforesaid Clerkás Office in Deed Book 552, Page 218, which said covenants, reservations and restrictions are incorporated herein by reference.
This conveyance is also made subject to the restriction contained in the deed from Richard Wilhelm, Jr. and Kathryn L. Wilhelm, husband and wife, to Robert C. Morehardt and Margery J. Morehardt, husband and wife, which conveys Lot No. 49 C above and is of record in the aforesaid Clerkás Office in Deed Book 605, page 399, which said restriction forbids the erection of any buildings on said Lot No. 49C and recites that Lot No. 50 and the adjoining Lot No. 49C shall be considered for all purposes one lot. Being that property conveyed unto Mark D. Sheppard by CAMCO Title Agency, Inc, by Deed dated March 29, 2011, and to be recorded simultaneously herewith.

The referenced real estate will be conveyed with no covenants of warranty, and subject to all covenants, restrictions, easements, rights of way and reservations which may be a matter of record in the aforesaid Clerk’s Office or visible upon the ground, all prior liens and encumbrances, including, without limitation, liens for real estate taxes, incinerator, sanitary and sewer charges. The purchasers at the sale shall be responsible for paying the recording costs and also the tax on the privilege of transferring real property (the cost of the tax stamp to be affixed to the deed). The purchasers shall be responsible for payment of all real estate taxes.

The subject property will be sold in âAS ISã condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.

TERMS: $9000.00 in cash and/or certified funds as deposit at the time of sale with the balance due and payable within 30 days of the day of sale.

FEDERAL TAX LIEN: In the event that there are Federal Tax Liens against the property, the United States would have the right to redeem the property within a period of 120 days from the date of such sale or the period allowable for redemption under local law, whichever is longer.

Pursuant to the Deed of Trust, the Trustee may postpone the sale by public announcement at the time and place designated or by posting a notice of the same, and act by agent in the execution of the sale. NOTICE OF FILING AND HEARING

On May 31, 2019, Hope Gas, Inc., doing business as Dominion Energy West Virginia filed its Annual Pipeline Replacement and Expansion Program (PREP) Filing with revised PREP Rates, pursuant to W. Va. Code Œ 24-2-1k, which authorizes the Public Service Commission of West Virginia to approve cost recovery of projects to replace, upgrade, and expand natural gas utility infrastructure that are deemed to be just and reasonable and in the public interest.

In its Application, Dominion Energy West Virginia projects PREP capital investment for calendar year 2020 of $39.5 million as part of its multi-year plan. The Application also contains a true-up for actual versus projected 2018 calendar year PREP capital investment activity. The PREP covers several categories of plant asset replacements and improvements, including mains, service lines, regulator stations and other plant equipment. These plant investments are proposed to be made in Dominion Energy West Virginia service territories throughout the State. These projects are identified in the Application, which is on file and available for public inspection at the Commission’s offices at 201 Brooks Street, Charleston, West Virginia.

Dominion Energy West Virginia proposes to recover costs associated with these investments through an additional increment within the fixed or volumetric, base rate component of its rates depending on the applicable rate schedule under which service is rendered, to be effective on November 1, 2019. Dominion Energy West Virginia projects that if the program and rate increments are approved as requested, the average monthly bill for its various classes of customers will be changed on November 1, 2019, as follows:

The increases shown are based on averages of all customers in the indicated classes. Each class may receive an increase greater or less than stated here. Individual customers may receive increases that are greater or less than average. Furthermore, the requested increased rates and charges are only a proposal and are subject to change (increase or decrease) by the Public Service Commission in its review of this filing. Any increase in rates and charges will not become effective until authorized and approved by the Public Service Commission.

The Commission set a procedural schedule, including a hearing on the Application, if necessary, that will begin at 9:30 a.m. on Tuesday, September 17, 2019, in the Howard M. Cunningham Hearing Room at the Commission’s offices at 201 Brooks Street, Charleston, West Virginia. If no opposition to the Application is received by the Commission within one week of the hearing date, the hearing may be waived and the Commission may issue a final order within 150 days of the Application filing date.

Anyone desiring to intervene should file a written petition to intervene within 20 days following the date of this publication unless otherwise modified by Commission order. All requests to intervene should briefly state the reason for the request to intervene and comply with the rules on intervention set forth in the Commission’s Rules of Practice and Procedure. The Commission will receive public comments until the beginning of the hearing. Appalachian Power plans to maintain a portion of its power line rights of way in West Virginia through aerial application of registered herbicides. Weather permitting, the program will begin on or about June 1, 2019.

Questions about the program or information about sensitive areas near the power lines listed below, such as springs, wells, streams, lakes, ponds, orchards, crop areas, gardens, pastures, meadows, year-round dwellings, public recreation areas, and Christmas tree farms, may be directed to the company by calling toll-free 1-800-642-3622.

Right-of-way maintenance agreements between the company and landowners are available to those preferring to accept responsibility for clearing the right of way crossing their property in lieu of aerial herbicide applications. Such agreements provide for compensation equivalent to the cost of aerial herbicide maintenance, provided the work meets the company’s specifications.

Landowners desiring to enter into right-of-way maintenance agreements with Appalachian Power should call the toll-free number above, or contact the nearest office as listed below. Maps showing the location of rights of way to be maintained in their areas also are available for inspection at these offices.

Herbicides to be used have been extensively tested and are registered by the U.S. Environmental Protection Agency and the West Virginia Department of Agriculture. They are glyphosate, imazapyr, metsulfuron methyl, fosamine, triclopyr, aminocy- clopyrachlor and aminopyralid. All applications are performed by certified applicators.

PLEASANTS COUNTY

Kammer-Mountaineer 765 kV ­ A transmission line on steel structures beginning at the Mitchell Plant in Moundsville, running south and passing the mid-points of Proctor, New Martinsville, Sistersville, St. Marys and Belmont. The line then passes through the Belmont Station, running southeast and passing the mid-points of Walker, Rockport, Sandyville, Ripley and Letart, and ending at the Mountaineer Plant in New Haven.

Complaints about possible damage resulting from herbicides may be made by contacting the company at the above toll-free number or the local office listed below. Complaints also may be directed to the state Department of Agriculture, Pesticide Regulatory Programs Unit, which may be contacted in Charleston at 1-304-558-2209.

NOTICE TO CUSTOMERS

Appalachian Power plans to maintain a portion of its power line rights of way in West Virginia through aerial application of registered herbicides. Weather permitting, the program will begin on or about June 1, 2019.

Questions about the program or information about sensitive areas near the power lines listed below, such as springs, wells, streams, lakes, ponds, orchards, crop areas, gardens, pastures, meadows, year-round dwellings, public recreation areas, and Christmas tree farms, may be directed to the company by calling toll-free 1-800-642-3622.

Right-of-way maintenance agreements between the company and landowners are available to those preferring to accept responsibility for clearing the right of way crossing their property in lieu of aerial herbicide applications. Such agreements provide for compensation equivalent to the cost of aerial herbicide maintenance, provided the work meets the company’s specifications.

Landowners desiring to enter into right-of-way maintenance agreements with Appalachian Power should call the toll-free number above, or contact the nearest office as listed below. Maps showing the location of rights of way to be maintained in their areas also are available for inspection at these offices.

Herbicides to be used have been extensively tested and are registered by the U.S. Environmental Protection Agency and the West Virginia Department of Agriculture. They are glyphosate, imazapyr, metsulfuron methyl, fosamine, triclopyr, aminocy- clopyrachlor and aminopyralid. All applications are performed by certified applicators.

Kammer-Mountaineer 765 kV ­ A transmission line on steel structures beginning at the Mitchell Plant in Moundsville, running south and passing the mid-points of Proctor, New Martinsville, Sistersville, St. Marys and Belmont. The line then passes through the Belmont Station, running southeast and passing the mid-points of Walker, Rockport, Sandyville, Ripley and Letart, and ending at the Mountaineer Plant in New Haven.

Complaints about possible damage resulting from herbicides may be made by contacting the company at the above toll-free number or the local office listed below. Complaints also may be directed to the state Department of Agriculture, Pesticide Regulatory Programs Unit, which may be contacted in Charleston at 1-304-558-2209.

NOTICE IS HEREBY GIVEN that, default having been made in the payment of the indebtedness secured by the deed of trust hereinafter described, and the undersigned having been required so to do by the owner and holder of said indebtedness, the undersigned Substitute Trustee {see General Lien Book No. 1822, at page 733 thereof} will offer for sale at the front door of the Wood County Courthouse, Parkersburg, West Virginia, on

Being the same real estate conveyed by Eric Allen Chichester and Trudy Lynn Chichester, husband and wife to George B. Fox, unmarried, by Deed dated May 10, 2001, of record in the aforesaid Clerk’s Office in Deed Book 1025, at page 920.

This conveyance is made subject to all exceptions, reservations, restrictions and conveyances as set forth of record in prior instruments hereto.

10.Neither the owner and holder of the indebtedness secured by the underlying deed of trust nor the substi tute trustee shall have any duty to cause any existing tenant or person or per sons occupying the subject property to vacate said property.

11.Any personal belongings remaining in the subject premises after sale shall be deemed abandoned and may thereafter be disposed of at the succussful bidderás or biddersá discretion.
