NOTICE OF INTENT TO REQUEST RELEASE OF FUNDS

These notices shall satisfy two separate but related procedural requirements for activities to be undertaken by the Parkersburg/Wood County HOME Consortium

 

REQUEST FOR RELEASE OF FUNDS

 

On or about October 19, 2018 the Parkersburg/Wood County HOME Consortium will submit a request to the U.S. Housing & Urban Development for the release of HOME Investment Partnership funds under Title II of the Cranston-Gonzales National Affordable Act, to undertake a project known as 4204 Lincoln St. CHDO New Home Construction for the purpose of The Consortium will provide funding to its Community Housing to its Community Housing Development Organization (CHDO) to construct a single family home located at 4204 Lincoln St. Parkersburg, WV. Once constructed, the home will be sold to an eligible low income homebuyer. $85,000 in HOME funds will be awarded to the CHDO as a subrecipient of the Parkersburg/Wood County HOME Consortium. The overall projects budget is $121,000.

 

FINDING OF NO SIGNIFICANT IMPACT

 

The Parkersburg/Wood County HOME Consortium has determined that the project will have no significant impact on the human environment. Therefore, an Environmental Impact Statement under the National Environmental Policy Act of 1969 (NEPA) is  not required. Additional project information is contained in the Environmental Review Record (ERR) on file at the City of Parkersburg Development Department, Fifth Floor of the Municipal Buildinig. One Government Square, Parkersburg, WV 26102. and may be examined or copied weekdays 8:00 A.M. to 4:00 P.M.

 

PUBLIC COMMENTS

 

Any individual, group, or agency may submit written comments on the ERR to Ryan Barber, Development Projects Administrator. All comments received by October 19, 2018 will be considered by the City of Parkersburg prior to authorizing submission of a request for release of funds. Comments should specify which Notice they are addressing.

 

ENVIRONMENTAL CERTIFICATION

 

The Parkersburg/ Wood County HOME Consortium certifies to HUD that Tom Joyce in his capacity as Parkersburg City Mayor consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in releation to the environmental review process and that these responsibilities have been satisfied. HUDás approval of the certification satisfies its responsibilities under NEPA and related laws and authorities and allows the City of Parkersburg to use Program funds.

 

OBJECTIONS TO RELEASE OF FUNDS

 

HUD will accept objections to its release of fund and the City of Parkersburgás certification for a period of fifteen days following the anticipated submission date or its actual receipt of the request (whichever is later) only if they are on one of the following bases: (a) the certification was not executed by the Certifying Officer of the City of Parkersburg; (b) the City of Parkersburg has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR part 58; (c) the grant recipient or other participants in the development process have committed funds, incurred costs or undertaken activities not authorized by 24 CFR Part 58 before approval of a release of funds by HUD; or (d) another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality. Objections must be prepared and submitted in accordance with the required procedures (24 CFR Part 58, Sec. 58.76) and shall be addressed to HUD/Pittsburgh Field Office at William Moorhead Federal Buidling 1000 Liberty Avenue, Suite 1000. Pittsburgh, PA 15222-4004. Potential objectors should contact HUD/Pittsburgh Field Office to verify the actual last day of the objection period.

In response to a release of petroleum products from regulated tanks, the property owner/operator under the direction of the Tanks Corrective Action Unit of the Department of Environmental Protection developed a draft corrective action plan addendum (CAPA) for the following site:

WHEREAS, the retirement of the Honorable Menis E. Ketchum has caused a vacancy in the office of Justice of the West Virginia Supreme Court of Appeals; and

WHEREAS, Article VIII, Section seven of the Constitution of West Virginia provides that if from any cause a vacancy shall occur in the office of a justice of the supreme court, the Governor shall issue a directive of election to fill such vacancy in the manner prescribed by law for electing a Justice of the Supreme Court and the Justice shall be elected for the unexpired term; and

WHEREAS, Section three, Article ten, chapter three of the Code of West Virginia, 1931, as amended, provides that where an unexpired term of office for a Justice of the supreme court is for a period of more than two years, the vacancy shall be filled by a successor who has timely filed a certificate of candidacy and has been elected in a non-partisan election and qualified to fill the unexpired term; and

WHEREAS, at the time of Justice Ketchum’s retirement, more than two years remained unexpired in the term of office of Justice of the West Virginia Supreme Court of Appeals.

NOW, THEREFORE, I, JIM JUSTICE, Governor of the State of West Virginia, under the authority vested in me by the Constitution of West Virginia and the laws of this State, do hereby proclaim and declare that the unexpired term of office for Justice of the West Virginia Supreme Court of Appeals shall be filled by the voters of West Virginia at an election to be held concurrently with the general election held on the sixth day of November, Two Thousand Eighteen.

WHEREAS, at the time of Justice Davis’s retirement, more than two years remained unexpired in the term of office of Justice of the West Virginia Supreme Court of Appeals.

NOW, THEREFORE, I, JIM JUSTICE, Governor of the State of West Virginia, under the authority vested in me by the Constitution of West Virginia and the laws of this State, do hereby proclaim and declare that the unexpired term of office for Justice of the West Virginia Supreme Court of Appeals shall be filled by the voters of West Virginia at an election to be held concurrently with the general election held on the sixth day of November, Two Thousand Eighteen.
