PROCEDURAL ORDER
This Order requires the Applicant to mail separate notices to each of its customers pursuant to Œ150-2-30.24 and make due return to the Commission, within thirty days of the date of this Order, of a certificate that notice has been provided. Additionally, Staff is required to file its further final substantive recommendation in this matter on or before April 17, 2017.
PROCEDURE
On December 2, 2016, Five Star Moving & Storage, Inc, (Applicant), Marietta, Ohio, filed an application to increase its rates and charges under P.S.C.M.C. Certificate No. F-6648.
On January 5, 2017, Staff Attorney Chris Howard filed the Initial and Final Joint Staff Memorandum, to which was attached the January 3, 2017 Utilities Division Initial and Final Staff Memorandum filed by Steven M. Kaz, Utilities Analyst Supervisor, Utilities Division. Staff reported on the Applicantás filing. Staff recommended the ease be dismissed since the Applicant had not submitted its most recently filed federal income tax return, as required.
On January 10, 2017, the Applicant filed a tax return under seal.
By Commission Order dated January 17, 2017, the proceeding was referred to the Division of Administrative Law Judges with a decision due date of on or before September 5, 2017. Staff was required to file its report with the Commission on or before April 17, 2017.
ORDER
IT IS, THEREFORE, ORDERED that the Applicant comply with the separate notice requirements under the Commissionás Rules for the Construction and Filing of Tariffs Œ150-230.2.d by completing the mailing of separate notices to each of its customers, within. thirty days of the date of this Order, and filing a completed certificate in the form of M.C. Tariff Form No. 6-A, on or before February 27, 2017.
IT IS FURTHER ORDERED that Staff file its further final substantive recommendation on or before April 17, 2017.
IT IS FURTHER ORDERED that the Executive Secretary serve this Order upon Commission Staff by hand delivery, upon all parties of record who have filed an e-service agreement with the Commission by electronic service and upon all other parties by U.S. Certified Mail, return receipt requested.
