NOTICE OF TRUSTEE’S SALE is hereby given pursuant to and by virtue of the authority vested in the Substitute Trustee, WV Trustee Services, LLC, by that certain Deed of Trust dated August 4, 2006, executed by Borrower(s), Shawna L Mercer, to Norman L. Folwell, Esq., the Trustee of record in the office of the Clerk of the County Commission of Wood County, West Virginia, in Book 1376, at Page 619. At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 39 Mill View Dr, Parkersburg, WV 26181. WV Trustee Services, LLC were appointed as Substitute Trustees by APPOINTMENT OF SUCCESSOR TRUSTEE dated January 10, 2017, of record in the Clerk’s Office in Book 1954, Page 881. The borrower(s) defaulted under the Note and Deed of Trust and the Substitute Trustees have been instructed to foreclose under the Deed of Trust. Accordingly, the Substitute Trustees will sell the following described property to the highest bidder at the front door of the Courthouse of Wood County, in Parkersburg, West Virginia, on the following date:

BEGINNING at a point in the easterly line of Croft Street, as shown on a plat of Nicolette, of record in the Office of the Clerk of the County Commission of Wood County, West Virginia, in Plat Book No. 2, at page 47, said beginning point begin the northeasterly corner of Lot âCã as shown on said plat; thence running with said line of Croft Street in a southwesterly direction, 231 feet to a point in said line; thence S. 46 degrees 52 minutes E. 203.85 feet to an iron pipe in the westerly line of Lot No. 59 of Nicolette; thence with said line S. 30 degrees 10 minutes W. 11.84 feet to a point, a common corner of Lots Nos. 58 and 59 of Nicolette; thence with the common line of said Lots Nos. 58 and 59, 110 feet, more or less (shown on the said plat as â120 feetã, but determined by survey to be â110 feetã), to a point in the westerly line of Park Street, as shown on said plat; thence with said line of Park Street, N. 30 degrees 10 minutes E. 400 feet to a point; thence N. 59 degrees W. with the easterly line of Lot No. 68 of said Nicolette, 110 feet (erroneously described as 120 feet on said plat), more or less, to a point, the northwesterly corner of said Lot No. 68; thence with the westerly line of Lots Nos. 68, 67 and 66 of Nicolette; 120 feet to a point, a common corner to Lots Nos. 65 and 66 of Nicolette; thence N. 59 degrees 50 minute W., crossing a 20 foot alley, 225 feet, more or less, and with the northerly line of said Lot âCã to the place of beginning; there being included in the above described boundaries, Lots Nos. Being the same property conveyed to Shawna L Mercer, by the Deed dated August 4, 2006 and recorded in Deed Book 1101 at Page 571 in the Office of the Clerk of the County Commission of Wood County, West Virginia.
TERMS OF SALE:
1) The property will be conveyed in an âAS ISã physical condition by Deed containing no warranty, express or implied, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights- of-ways, easements, covenants, conveyances and conditions of record in the Clerkás office or affecting the subject property.
2) The Purchaser shall be responsible for the payment of the transfer taxes imposed by the West Virginia Code Œ 11-22-1.
3) The Beneficiary and/or the Servicer of the Deed of Trust and Note reserve the right to submit a bid for the property at sale.
4) The Trustee reserves the right to continue sale of the subject property from time to time by written or oral proclamation, which continuance shall be in the sole discretion of the Trustee.
5) The Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, and any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY.
6) The total purchase price is payable to the Trustee within thirty (30) days of the date of sale, with ten (10%) of the total purchase price payable to the Trustee at sale.
