The Wood-Washington-Wirt Interstate Planning Commission (WWW) is considering amendments to the Fiscal Year 2016-2019 Transportation Improvement Program (TIP) for the Wood County, West Virginia and Washington County, Ohio portions of the document. The TIP provides a list of highway, transit, and bicycle and pedestrian projects programmed over a four period utilizing federal funds. In accordance with the public participation procedures for WWW, anyone interested in reviewing or commenting on the proposed project amendments can contact the WWW office at (304) 422-4993 ext. 125 or visit the agency website located at www.triplew.org for project specific information. Any comments related to the TIP amendments can be made by emailing them to randy.durst@movrc.org or by calling the above referenced number. All comments must be received by March 14, 2017. The referenced real estate will be conveyed with no covenants of warranty, and subject to all covenants, restrictions, easements, rights of way and reservations which may be a matter of record in the aforesaid Clerk’s Office or visible upon the ground, all prior liens and encumbrances, including, without limitation, liens for real estate taxes, incinerator, sanitary and sewer charges. The purchasers at the sale shall be responsible for paying the recording costs and also the tax on the privilege of transferring real property (the cost of the tax stamp to be affixed to the deed). PUBLIC NOTICE OF CHANGE IN RATES IN EFFECT SUBJECT TO REFUND

 

Notice is hereby given that Union Williams Public Service District, a public utility, has on January 18, 2017, filed with the PUBLIC SERVICE COMMISSION OF WEST VIRGINIA, an application containing increased rates, tolls and charges for furnishing sewer service to approximately 1,800 customers in Wood and Pleasants Counties, including the communities of Valley Mills, Waverly, Northwood Villa, Parkerstown, Oak Grove Road, Mullenix Addition, Woodland Falls, Wood & Pleasants Counties Industrial Parks, Oakwood Estates/Granada Hill, Par Metta Crest, Brierwood, Elmwood Heights, Wood County Airport, and Mountaineer Mobile Home Park.

 

The District proposes a two-step rate change. The first step of the rate change, to be in effect for 30 months, will produce approximately $60,148 annually in additional revenue, an increase of approximately 3.7%. The second step of the rate change, to be in effect after 30 months, will produce approximately $185,285 less in revenue than the first step of the rate change, a decrease of approximately 11.6%.

 

The average monthly bill for the various classes of customers under the District’s proposed Step 1 rate change will be changed compared to the rates now in effect as follows:

The changes shown are based on averages of all customers in the indicated class.  Individual customers may receive changes that are greater or less than average. The requested rates and charges went into effect subject to refund on the date the utility filed its rate application and are subject to change (increases or decreases) by the Public Service Commission in its review of this filing. Each class may receive an increase or decrease greater or less than stated here. Individual customers may receive increases that are greater or less than average. If the Commission approves lower rates, the utility will be required to make customer refunds consistent with W.Va. Code Œ24-2-4a and Commission order. (If a hearing is scheduled, notice will be given of the time and place of hearing.)

 

Anyone desiring to protest or intervene should file a written protest or notice of intervention prior to April 20, 2017 unless otherwise modified by Commission order. Failure to timely protest or intervene can affect your rights to protest any rate increases and to participate in future proceedings. All protests or requests to intervene should briefly state the reason for the protest or intervention. Requests to intervene must comply with the Commission’s rule on intervention set forth in the Commission’s Rules of Practice and Procedure. Title V of the Federal Clean Air Act and the state Air Pollution Control Act requires that all major sources and certain minor sources have a permit to operate which states all requirements (e.g. emission limitations, monitoring requirements, etc.) established by regulations promulgated under the aforementioned programs. The Division of Air Quality (DAQ) has determined that the draft/proposed permit referenced herein meets this requirement.

The DAQ is providing notice to the general public of its preliminary determination to issue an operating permit significant modification to the following company for operation of the referenced chemical plant:

This notice solicits comments from the public and affected state(s) concerning the above preliminary determination and provides an opportunity for such parties to review the basis for the proposed approval and the âdraftã permit modification.  This notice also solicits comments from the U.S. EPA concerning the same preliminary determination and provides an opportunity for the U.S. EPA to concurrently review the basis for the proposed approval as a âproposedã permit. This notice also incorporates changes to the General Requirements of the following preconstruction permit(s): N/A.

All written comments submitted by the public and affected state(s) pursuant to this notice must be received by the DAQ within thirty (30) days of the date of publication of this notice.  Under concurrent review, written comments submitted by the U.S. EPA must be received by the DAQ within forty-five (45) days from the date of publication of this notice or from the date the U.S. EPA receives this draft/proposed permit modification, whichever is later. In the event that the 30th/45th day is a Saturday, Sunday, or legal holiday, the comment period will be extended until 5:00 p.m. on the following regularly scheduled business day. The public shall have 135 days from the date of publication of this notice to file petitions for concurrently reviewed permits. Upon notice by the U.S. EPA to the DAQ, prior to the end of the 45-day notice period, the U.S. EPA may choose to hold the 30 day comment period on the draft permit and the 45 day comment period on the proposed permit sequentially. During the public comment period any interested person may submit written comments on the draft permit and may request a public hearing, if no public hearing has already been scheduled. A request for a public hearing shall be in writing and shall state the nature of the issues proposed to be raised in the hearing. The Director of the DAQ shall grant such a request for a hearing if he concludes that a public hearing is appropriate. Any public hearing shall be held in the general area in which the facility is located, after 30 day notice is given. The DAQ will consider all written comments prior to final action on the permit.

Public Notice Date: March 2, 2017

 

The West Virginia Department of Environmental Protection (DEP), Division of Air Quality (DAQ) and Division of Water and Waste (DWWM), intends to issue a hazardous waste management permit to E.I du Pont de Nemours and Company for the operation of a hazardous waste boiler for preventing and controlling organic air emissions from containers. Also included are hazardous waste management units under RCRA. This permit will be issued under the authority of West Virginia Codes ŒŒ 22-5-1 et seq. and ŒŒ 22-18-1 et seq. and both 45 CSR 25 and 33 CSR 20. The facility has been assigned EPA identification number WVR000532440 and is located at 8480 DuPont Road, Washington, WV 26181.

 

The State of West Virginia is authorized to administer and enforce a hazardous waste management program in lieu of the federal program for the portions of the Resource Conservation and Recovery Act of 1976 (RCRA), including the Hazardous and Solid Waste Amendments of 1984 (HSWA). The Hazardous Waste Management Act (chapter 22, Article 18 of the West Virginia Code) and State rules 33 CSR 20 and 45 CSR 25 set forth procedures for the WVDEP to provide the public with an opportunity to participate in the permitting process.

 

The permit, which contains conditions for the operation of the above mentioned units, is not final and is open to comment from the public. If there is significant interest expressed in the permit or if there is a request for a public hearing, the Director will hold a public hearing if it is concluded a hearing is appropriate. Comments on the permit and request for public hearing must be in writing and submitted within forty-five (45) days of this notice to:
