Notice of Proposed Telecommunications Tower: Public Participation

PI Tower Development LLC is proposing to construct a new lattice style telecommunications tower at 386 Dana Road, Newport, Washington County, OH 45768 N 39* 24′ 15.8″, W 81* 13′ 17.3″. The height of the tower will be 96.3-meters above ground level (316 feet above ground level), 102.4-meters above ground level with appurtenances (336 feet above ground level with appurtenances). The tower will be lit with FAA Style E medium intensity dual lighting. Specific information regarding the project is available by calling RESCOM Environmental at 260-385-6999 during normal business hours. The State of West Virginia, Department of Environmental Protection, Division of Water and Waste Management (DWWM) is proposing to modify and reissue the West Virginia National Pollutant Discharge Elimination System (NPDES) General Water Pollution Control Permit for Stormwater Associated with Industrial Activities. The General Permit authorizes discharges to waters of the state from various industrial activities as defined in the General Permit. The draft modification does not propose to extend the expiration date of the General Permit which is September 12, 2024.

DWWM is proposing the modification in response to agreed Order Number 19-13-EQB issued by the West Virginia Environmental Quality Board and to incorporate comments from the EPA, which were provided upon review of the proposal.

The Draft Permit and Fact Sheet may be inspected by appointment between 8:00 a.m. and 4:00 p.m., Monday through Friday from September 17, 2020 – October 23, 2020 at the Department of Environmental Protection, Division of Water and Waste Management, 601 57th Street SE, Charleston, WV 25304. Copies of the documents may be obtained from the Division at a nominal cost.

Hearing impaired individuals having access to a Telecommunication Device for the Deaf (TDD) may contact our agency by calling (304) 926-0489. Calls must be made between 8:00 a.m. to 4:00 p. m. Monday through Friday.

NOTICE OF PUBLIC COMMENT PERIOD

TWO PROPOSED GENERAL PERMITS TO REGULATE THE FOLLOWING ACTIVITIES:

(1) WVGS10000 LAND APPLICATION OF SEWAGE SLUDGE AND/OR DOMESTIC SEPTAGE

(2) WVGS20000 TRANSPORTERS AND/OR HAULERS DISPOSING SEWAGE SLUDGE AND/OR DOMESTIC SEPTAGE

The Department of Environmental Protection’s (DEP) Division of Water and Waste Management (DWWM) is proposing to reissue two General Permits to facilitate sludge management regulatory procedures for septic tank cleaners. DWWM plans to issue these general permits under the authority and mandate of the West Virginia Sewage Sludge Management Regulations (Title 33, Series 2).

The purpose of these permits is two-fold:

First, DWWM wants to continue efficient, environmentally sound procedures for transportation and land application of sewage sludge and/or domestic septage.

Second, DWWM believes these general permits will be successful in streamlining the permitting process through issuing coverage to any owner who can demonstrate the ability to achieve compliance.

Any owner of: (1) a sewage or septage pumping operation who land applies sludge and/or domestic septage at land application sites for agricultural or land reclamation purposes; and/or (2) any owner of a sewage or septage pumping operation who transports sewage sludge and/or domestic septage to sewage treatment facilities; that can qualify under the terms and conditions of the proposed General Permit may apply.

However, despite General Permit eligibility, the DWWM Director can require any owner to apply for and obtain an individual permit. The Director can exercise this authority when it is determined that such a permit will better protect human health and the environment.

New individuals seeking coverage under these General Permits must complete and submit a permit registration application form. To allow for continued coverage during the reissuance process, the DWWM will extend permit coverage for six months to all individuals who currently are registered under these two (2) General Permits. These individuals will be required to submit a permit registration reissuance application for continued coverage beyond the extension date.

Those accepting General Permit coverage agree to comply with all permit terms and conditions. Permit provisions include, but are not limited to: monitoring and reporting requirements; tracking reports and record keeping; inspection and entry guidelines, siting restrictions and location standards. Also included in the General Permit are soil pH requirements, land use and sludge spreading requirements; disease-causing agent reduction and pest control measures; and removal of other solid wastes and groundwater protection standards.

The draft permit and fact sheet may be inspected by appointment between 8 a.m. and 4 p.m., Monday through Friday at the Department of Environmental Protection, Public Information Office, 601 57th Street, S.E., Charleston, WV 25304. Copies of the document may be obtained at a nominal cost.

The Wood County Commission will be holding a Public Hearing on Monday, September 28, 2020 at 6:00 P.M. in Bicentennial Park located at 3rd and Market Streets, Parkersburg, WV. The Wood County Commission will discuss a proposed water and sewer rate increase requested by the Lubeck Public Service District. Social distancing guidelines will be followed.

WATER RESOLUTION

In order to pay the costs associated with increases relating to general operation and maintenance, and by reason of the requirements set forth in West Virginia Code Chapter 16, Article 13A, as amended, Lubeck Public Service District hereby adopts and increase in its current rates and charges for water service by increasing the previous rates for residential, commercial, industrial and public authorities by an approximate aggregate rate of 8.25%, the specific percentage of rate increases in the respective categories are set forth below. We will be using products from the Mohawk Group. The LVT flooring will be selected from their Living Local Collection and the carpet planks will be selected from their Learn and Live Collection. There is 11,615 square feet of carpet and 1,500 square feet of LVT. We require installation of a 4′ cove base and flooring transitions where required.

The object of the above entitled action is a suit for an Unlawful Detainer.
It appearing by affidavit filed in this action that Rebecca Louise Bundy, and/or any current occupants are individual defendants and that the plaintiff has used due diligence to ascertain the residence or whereabouts of the defendants, without effect, and that in this action that Emmanuel D. Voces, Esquire, counsel for plaintiff, has used due diligence to ascertain the whereabouts of the defendants Rebecca Louise Bundy and/or any current occupants via personal service on August 21, 2020 without effect, it is therefore
ORDERED that Rebecca Louise Bundy and/or any current occupants do appear and serve upon Emmanuel D. Voces, Esquire, and the law firm of Samuel I. White, PC, plaintiff’s attorney, whose address is 596 Lynnhaven Parkway Suite 200, Virginia Beach, Virginia 23452, an answer or other response to the Complaint on or before thirty (30) days from second date of publication, otherwise judgment by default will be entered against Rebecca Louise Bundy and/or any current occupants at any time thereafter.
A copy of said complaint can be obtained from the undersigned Clerk at her office located in Wood County, West Virginia.
