Any person seeking to impeach or establish a will must make a complaint in accordance with the provisions of West Virginia Code 41-5-11 through 13. NOTICE OF TRUSTEE’S SALE is hereby given pursuant to and by virtue of the authority vested in the Substitute Trustee, WV Trustee Services, LLC, by that certain Deed of Trust dated January 3, 2013, executed by Borrowers, Duane Kyle Sutton Jr and Susan Elizabeth Sutton, to Teays Valley Trustee, LLC, the Trustee of record in the office of the Clerk of the County Commission of Wood County, West Virginia, in Book 1743, at Page 769. At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 4602 Stillwell Rd, Davisville, WV 26142. WV Trustee Services, LLC were appointed as Substitute Trustees by APPOINTMENT OF SUCCESSOR TRUSTEE dated May 10, 2019, of record in the Clerk’s Office in Book 2066, Page 0590. The borrowers defaulted under the Note and Deed of Trust and the Substitute Trustees have been instructed to foreclose under the Deed of Trust. Accordingly, the Substitute Trustees will sell the following described property to the highest bidder at the front door of the Courthouse of Wood County, in Parkersburg, West Virginia, on the following date:

The property is described as of that certain lot or parcel of land, together with the improvements thereon and the appurtenances thereunto belonging, situate in Clay District, Wood County, West Virginia, and being more particularly described as follows:

First Tract: Beginning at a point 20 feet from the center line of Stillwell Road in the northerly line of said Stillwell Road where it is intersected by a 40 foot private street called Marwico Road; thence with the westerly line of said private street 280 feet to a point; thence at right angles in a westerly direction and parallel with Stillwell Road 110 feet to a point; thence in a southerly direction and parallel with the line of the said private street 280 feet to the northerly line of Stillwell Road, 20 feet from the center line thereof; thence with the northerly line of Stillwell Road 110 feet in an easterly direction to the place of beginning.

Second Tract: Beginning at a point 20 feet from the center line of Stillwell Road in the north line thereof and in the northwest corner of a lot sold by the parties of the first part to the parties of the second part by deed dated May 7, 1973, and recorded in the Office of the Clerk of the County Commission of Wood County, West Virginia, in Deed Book No. 616, at page 279; thence with the line of the Stillwell Road in a westerly direction 20 feet to a point, 20 feet from the center line of the said Road; thence in a northwesterly direction and parallel with the westerly line of the lot heretofore sold to Ong 280 feet to a point; thence in an easterly direction 20 feet to the northwest corner of the Ong tract; thence with the westerly line of the Ong tract 280 feet in a southerly direction to the place of beginning.

Being the same property conveyed to Duane Kyle Sutton Jr and Susan Elizabeth Sutton by the Deed dated April 24, 2008 and recorded in Deed Book 1126 at Page 923 in the Office of the Clerk of the County Commission of Wood County, West Virginia.

TERMS OF SALE:

1) The property will be conveyed in an âAS ISã physical condition by Deed containing no warranty, express or implied, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights-of-ways, easements, covenants, conveyances and conditions of record in the Clerkás office or affecting the subject property.

2) The Purchaser shall be responsible for the payment of the transfer taxes imposed by the West Virginia Code Œ 11-22-1.

3) The Beneficiary and/or the Servicer of the Deed of Trust and Note reserve the right to submit a bid for the property at sale.

4) The Trustee reserves the right to continue sale of the subject property from time to time by written or oral proclamation, which continuance shall be in the sole discretion of the Trustee.

5) The Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, and any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY.

6) The total purchase price is payable to the Trustee within thirty (30) days of the date of sale, with ten (10%) of the total purchase price payable to the Trustee at sale.

Questions about the program or information about sensitive areas near the power lines listed below, such as springs, wells, streams, lakes, ponds, orchards, crop areas, gardens, pastures, meadows, year-round dwellings, public recreation areas, and Christmas tree farms, may be directed to the company by calling toll-free 1-800-642-3622.

Right-of-way maintenance agreements between the company and landowners are available to those preferring to accept responsibility for clearing the right of way crossing their property in lieu of aerial herbicide applications. Such agreements provide for compensation equivalent to the cost of aerial herbicide maintenance, provided the work meets the company’s specifications.

Landowners desiring to enter into right-of-way maintenance agreements with Appalachian Power should call the toll-free number above, or contact the nearest office as listed below. Maps showing the location of rights of way to be maintained in their areas also are available for inspection at these offices.

Herbicides to be used have been extensively tested and are registered by the U.S. Environmental Protection Agency and the West Virginia Department of Agriculture. They are glyphosate, imazapyr, metsulfuron methyl, fosamine, triclopyr, aminocy- clopyrachlor and aminopyralid. All applications are performed by certified applicators.

Rights of way involved in the program are:

Kammer-Mountaineer 765 kV ­ A transmission line on steel structures beginning at the Mitchell Plant in Moundsville, running south and passing the mid-points of Proctor, New Martinsville, Sistersville, St. Marys and Belmont. The line then passes through the Belmont Station, running southeast and passing the mid-points of Walker, Rockport, Sandyville, Ripley and Letart, and ending at the Mountaineer Plant in New Haven.

Complaints about possible damage resulting from herbicides may be made by contacting the company at the above toll-free number or the local office listed below. Complaints also may be directed to the state Department of Agriculture, Pesticide Regulatory Programs Unit, which may be contacted in Charleston at 1-304-558-2209.

NOTICE TO CUSTOMERS

Appalachian Power plans to maintain a portion of its power line rights of way in West Virginia through aerial application of registered herbicides. Weather permitting, the program will begin on or about June 1, 2019.

Questions about the program or information about sensitive areas near the power lines listed below, such as springs, wells, streams, lakes, ponds, orchards, crop areas, gardens, pastures, meadows, year-round dwellings, public recreation areas, and Christmas tree farms, may be directed to the company by calling toll-free 1-800-642-3622.

Right-of-way maintenance agreements between the company and landowners are available to those preferring to accept responsibility for clearing the right of way crossing their property in lieu of aerial herbicide applications. Such agreements provide for compensation equivalent to the cost of aerial herbicide maintenance, provided the work meets the company’s specifications.

Landowners desiring to enter into right-of-way maintenance agreements with Appalachian Power should call the toll-free number above, or contact the nearest office as listed below. Maps showing the location of rights of way to be maintained in their areas also are available for inspection at these offices.

Herbicides to be used have been extensively tested and are registered by the U.S. Environmental Protection Agency and the West Virginia Department of Agriculture. They are glyphosate, imazapyr, metsulfuron methyl, fosamine, triclopyr, aminocy- clopyrachlor and aminopyralid. All applications are performed by certified applicators.

Kammer-Mountaineer 765 kV ­ A transmission line on steel structures beginning at the Mitchell Plant in Moundsville, running south and passing the mid-points of Proctor, New Martinsville, Sistersville, St. Marys and Belmont. The line then passes through the Belmont Station, running southeast and passing the mid-points of Walker, Rockport, Sandyville, Ripley and Letart, and ending at the Mountaineer Plant in New Haven.

Complaints about possible damage resulting from herbicides may be made by contacting the company at the above toll-free number or the local office listed below. Complaints also may be directed to the state Department of Agriculture, Pesticide Regulatory Programs Unit, which may be contacted in Charleston at 1-304-558-2209.

For Fiscal Year 2019-2020

In accordance with the federal regulations at 24 CFR, Part 91, the City of Parkersburg is required to prepare and submit an Annual Action Plan for its Housing Community and Economic Development Programs. In order to obtain the views of citizens, and other interested parties, the City will hold two public meetings regarding the FY2019 Annual Action Plan, which outlines how the City intends to spend Community Development Block Grant (CDBG) and HOME Investment Partnerships Program funds (HOME)
