NOTICE OF TRUSTEEáS SALE

 

Pursuant to the authority vested in the undersigned J. Patrick Jones, Substitute Trustee by Notice of Substitution of Trustee which notice is of record in the Office of the Clerk of the County of Commission of Wood County West Virginia, and by Deed of Trust dated July 17, 2015, executed by Jack Jerome Duke Jr. to BB&T Collateral Service Corporation, Trustee, which deed of trust is of record in the Office of the Clerk of Wood County, West Virginia, in Trust Deed Book 1881 at Page 910, the undersigned Substitute Trustee has been requested, in writing, by the beneficiary of said deed of trust to sell the real estate described below, as there has been a default under the terms and conditions of said deed of trust.  Therefore, the undersigned Substitute Trustee will sell the real estate described in the Deed of Trust, at a public auction on June 15, 2017 at 1:30 p.m. to the highest bidder at the front door of the Courthouse of said County of Wood, in Parkersburg, West Virginia, which real estate is more completely described as follows:

 

ALL THAT CERTAIN LOT, TRACT, OR PARCEL OF LAND, LYING AND BEING SITUATE IN THE DISTRICT OF TYGART, COUNTY OF WOOD, AND STATE OF WEST VIRGINIA, MORE PARTICULARLY BOUNDED AND DESCRIBED AS FOLLOWS:

 

BEGINNING AT A STAKE SET AT THE SOUTHWEST CORNER OF LOT 89 AND THE SOUTHEASTER CORNER OF LOT 83 OF THE ADDITION HEREINAFTER MENTIONED; THENCE WITH THE WESTERLY LINE OF LOT 89 AND THE EASTERLY LINES OF LOTS 83, 84, AND 85, N. 61 DEGREES 53 MINUTES E. 248.8 FEET TO A STAKE IN A LINE OF LOT 86; THENCE WITH THE LINE OF LOT 86 S. 28 DEGREES 07 MINUTES E. 84.9 FEET TO A STAKE IN THE WESTERLY LINE OF A.B. AND EDWIN COOPER 50-ACRE TRACT; THENCE WITH SAID LINE S. 18 DEGREES 12 MINUTES W. 181.3 FEET TO A PIPE; THENCE LEAVING SAID COOPER PROPERTY S. 41 DEGREES 40 MINUTES W. 74.19 FEET TO A STAKE; THENCE S. 68 DEGREES 42 MINUTES W. 108.12 FEET TO A STAKE IN THE TURN CIRCLE OF EARL P. STREET; THENCE WITH SAID CIRCLE WHOSE RADIUS IS 40 FEET IN A NORTHERLY DIRECTION ALONG THE CURVING EDGE OF THE CIRCLE TO THE LEFT A DISTANCE OF 32.64 FEET TO ANOTHER POINT ON SAID TURN CIRCLE WHICH POINT IS 5.46 FEET SOUTHERLY ALONG THE EDGE OF SAID CIRCLE FROM THE POINT WHERE THE ORIGINAL SOUTHERLY LINE OF LOT NO. 89 JOINS THE EDGE OF SAID CIRCLE; THENCE NO. 63 DEGREES 55 MINUTES E. 74.20 FEET TO A POINT IN THE SOUTHERLY LINE OF LOT NO. 89; THENCE N. 28 DEGREES 38 MINUTES E. 35.05 FEET TO A STAKE, A CORNER TO THE JUSTICE LOT; THENCE N. 47 DEGREES 30 MINUTES W. 191.8 FEET TO THE PLACE OF BEGINNING, BEING PART OF LOT 89 OF SOUTH ACRES ADDITION, A REVISED PLAT OF WHICH IS OF RECORD IN THE OFFICE OF THE CLERK OF THE COUNTY COMMISSION OF WOOD COUNTY, WEST VIRGINIA, IN PLAT BOOK NO. 11, AT PAGE 18.

 

TERMS OF SALE

 

  1. Cash in hand paid on the day of sale.

 

  1. The sale of the property will be made subject to all matters having priority over the deed of trust referred to herein including but not limited to any and all assessments and taxes against said property, all prior liens, encumbrances, lease, restrictions, covenants, conditions, right of ways and easements of any nature whatsoever.

 

  1. The purchaser shall be responsible for the payment of the transfer taxes imposed by West Virginia Code ç 11-22-2.

 

  1. The subject property will be sold in âAS ISã condition. The Substitute Trustee makes no representations and warranties of any kind or character including, but not limited to, the condition of the real estate or the title to the real estate to be conveyed.

 

  1. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.

 

  1. The Substitute Trustee reserves the right to adjourn the sale, for a time, or from time to time, without further notice by announcement at the time and place of the sale described above.

 

  1. The beneficiary of the Deed of Trust and holder of the note thereby secured reserves the right to submit a bid for the property at the sale, which bid may be in the form of a credit bid.

 

  1. Such other terms as may be announced at the time of Sale.
