IN THE MATTER OF THE BOARD OF EDUCATION OF

THE COUNTY OF WOOD, STATE OF WEST VIRGINIA,

$41,140,000 PUBLIC SCHOOL BONDS, SERIES 2017

 

ATTORNEY GENERAL’S APPROVAL

 

At a regular meeting held on August 23, 2016, the Board of Education of the County of Wood, State of West Virginia (the âBoard of Educationã), made and entered of record a Bond Election Order (the âOriginal Orderã), and at a regular meeting held on September 13, 2016, the Board of Education made and entered of record an Order Amending Bond Election Order (the âAmendatory Orderã and together with the Original Order, the âOrderã). The Order authorized a vote to be taken by the legal voters of the County of Wood at an election to be held on the 8th day of November, 2016, upon all questions connected with the incurrence of debt and issuance of bonds in the aggregate principal amount of Forty One Million One Hundred Forty Thousand Dollars ($41,140,000), and levying taxes to pay the interest on and the principal of said bonds, the proceeds from the sale of such bonds to be used for the purpose of:

The Board of Education of the County of Wood, pursuant to the provisions of Chapter 13, Article 1, Section 25, of the West Virginia Code of 1931, as amended, has caused to be transmitted to me duly certified copies of all the orders, ordinances, proclamations, notices, advertisements, affidavits, resolutions and records of the proceedings connected with or pertaining to such Bond Issue, and I have examined the same.

 

It appears from the records so transmitted to me that the proposition of incurring debt and issuing bonds, as provided in said Order, twenty thousand three hundred ten (20,310) votes were cast for and fourteen thousand two hundred ninety five (14,295) votes were cast against the issuance of said bonds, so that fifty-eight and sixty-nine hundredths percent (58.69%) of the voters in said election voted in favor of incurring debt and issuing bonds as provided in the Order.

 

In my opinion, there has been substantial compliance with the law relating to the issuance of said bonds and I, therefore, approve the validity of such Bond Issue pursuant to the provisions of Chapter 13, Article 1, Section 25, of the West Virginia Code, 1931, as amended.
