AMENDED NOTICE
This Notice is amended to reflect the correct date by which persons may file their claim to said property.
Notice is hereby given that the above-styled matter has been filed in the Circuit Court of Wood County, West Virginia, pursuant to the West Virginia Contraband Forfeiture Act (West Virginia Code 60A-7-701, et. seq.). Any person or corporation having a claim to the hereinafter described property shall, on or before the 15th day of March, 2017 file, in writing, their claim to said property with the Clerk of said Court, which said claim must clearly state the identity of the claimant and an address where legal process can be served upon such person or corporation. A copy of said claim shall be delivered to Patrick O. Lefebure, Prosecuting Attorney, Counsel for Petitioners, at the Office of the Wood County Prosecuting Attorney, Judge Donald Black Annex, 317 Market Street, Parkersburg, West Virginia 26101.
Pursuant to West Virginia Code 60A-7-705 (c)(1-6), the following information is given: (1) the property seized which is the subject of the petition filed is a 1999 Mitsubishi VIN 4A3AK44YXWE056185 and 9mm handgun; (2) the Parkersburg Police Department is responsible for the seizure; (3) the property was seized on October 7, 2016 at 1000 Block of Jeanette Street, Parkersburg, Wood County West Virginia; (4) the only owner(s) of the property subject to forfeiture known to Petitioners is Matthew Daniel Hebert or Dylon S. Nesselrotte; (5) the person having possession of the seized property at the time of the seizure wasMatthew Daniel Hebert or Dylon S. Nesselrotte; and (6) a request to the above named Court to enter an Order directing ownership of said property in the State and the Parkersburg Police Department will be made.
