PUBLIC NOTICE OF UNIFORM ENVIRONMENTAL COVENANT ACT-LEAKING UNDERGROUND STORAGE TANK PROGRAM SITE CLEANUP METHOD

PUBLIC NOTICE NO.: UECA-LUST #99-134

The Office of Environmental Remediation (OER) at the West Virginia Department of Environmental Protection has approved a cleanup method to address environmental conditions at the Former Prima Marketing Store #5629 (referred to as the “Site”) under the Uniform Environmental Covenant Act-Leaking Underground Storage Tank Program (UECA-LUST #99-134). The applicant, Prima Marketing, LLC, has been working with the WVDEP since negotiating a UECA-LUST Agreement on June 23, 2010.
The Site is located at 101 West 3rd Street, Williamstown, Wood County, West Virginia, and is comprised of approximately 0.365 acres of property. A release of petroleum hydrocarbons was detected and reported to WVDEP during assessment activities in January 1999. The source of the release was from an underground storage tank system that was closed by removal in April 2018.
The cleanup method for this Site included the injection of a bio-nutrient slurry and subsequent ground water monitoring. A Human Health and Ecological Risk Assessment (HHERA) was performed and the results concluded that the risk to potential non-residential receptors is acceptable. In order to ensure that the future use of the Site remains non-residential, a Land Use Covenant (LUC), referred to as an institutional control, was prepared and approved by the WVDEP. Upon completion of remediation, the applicant will submit a Final Report, documenting that all work is complete.

Current Site Use: The site is vacant and includes a one-story, slab-on-grade commercial
building. The remainder of the Site is covered by asphalt and concrete.

Contaminants of Contaminants of concern in groudwater include: benzo(a)anthracene,
Concern: benzo(a)pyrene, benzo(b)fluoranthene, benzo(k)fluoranthene,
indeno(1,2,3-cd)pyrene, benzene, methyl tert-butyl ether and
naphthalene.

Cleanup Method: The HHERA determined that the risk to potential non-residential
receptors is acceptable. In order to ensure that the future use of the
Site remains non-residential, a LUC was prepared and approved by
the WVDEP. The LUC restricts: 1) use of the Site for non-residential purposes, as defined by W. Va. Code § 22-22-2(bb); 2) use or
extraction of groundwater for any purpose, except for groundwater
monitoring and/or remediation; 3) excavation, drilling, or penetration from one to ten feet below ground surface unless various requirements are met as stipulated in the LUC; 4) any activity that may interfere
with the groundwater monitoring well network; and, 5) construction of
a building without a sub-slab vapor barrier and/or ventilation system adequate to prevent exposure to vapors in soil and groudnwater,
as determined by a West Virginia Licensed Remediation Specialist
or similarly qualified individual.

Remediation Soil: Industrial De Minimis standards.
Standards
Achieved: Groundwater: Risk based standards by performing a HHERA and
execution of the LUC.
