The undersigned Trustee, by virtue of the authority vested by that certain Deed of Trust, dated April 13, 2001, and duly recorded in the Office of the Clerk of the County Commission of Wood County, West Virginia, in Document No. 342461, in Book No. 938, at Page 827 and modified in Document No. 509543, in Book No. 1386, at Page 685 and subject to a Court Order recorded in Document No. 8721923, in Book No. 1939, at Page 550, Frances Greene did encumber certain real property described in said Deed of Trust; and Seneca Trustees, Inc., as having been appointed as Trustee by abovementioned Court Order recorded in the aforesaid Clerk’s office; and default having been made under the aforementioned Deed of Trust, and the undersigned Trustee having been instructed by U.S. Bank Trust, N.A., as Trustee for LSF9 Master Participation Trust to foreclose thereunder, will offer for sale at public auction at the front door of the Wood County Courthouse in Parkersburg, West Virginia, on

the following described real estate, together with its improvements, easements and appurtenances thereunto belonging, situate in Parkersburg District, Wood County, West Virginia, and more particularly described as follows:
All that certain lot, tract or parcel of land, situate in the City of Parkersburg, Wood County, West Virginia, and more particularly bounded and described as follows:
BEGINNING at a spike nail located in the southerly line of Niagara Street 21.0 feet, more or less, easterly from the extended easterly line of 18th Avenue; thence with the southerly line of Niagara Street in a northeasterly direction 63.74 feet, more or less, to a pipe; thence in a southeasterly direction 133 feet, more or less, to an iron rod set in the common line of Lots Nos. 100 and 101 of Dixie Terrace Addition to the City of Parkersburg, a plat of which said Addition is of record in the Office of the Clerk of the County Commission of Wood County, West Virginia, in Plat Book No. 4, at page 85; thence in a nearly southerly direction 9.2 feet, more or less, with said common line to an iron rod, common corner to said lots Nos. 100 and 101; thence in a near westerly direction 40 feet to a point which is the common corner of Lots No. 99 and 100 of said Addition; thence in a northwesterly direction 46.17 feet to an iron pipe; thence in another northwesterly direction 84.3 feet, more or less, to a spike nail, which is the place of beginning, and being a part of Lots No. 98, 99 and 100 of said Dixie Terrace Addition, and as more particularly shown on a plat of said lots drawn by Paul E. Marshall, Licensed Land Surveyor, which said plat is dated April 27, 1978, and recorded with the below referenced Deed.
Being the same property conveyed unto Frances D. Greene, by Deed dated May 10, 1978, filed for record in the aforesaid Clerkás Office in Deed Book 703, at page 813.
At the time of the execution of the Deed of Trust, this property was reported to have an address of: 1707 Niagara St, Parkersburg, WV 26101.
The referenced real estate will be conveyed with no covenants of warranty, and subject to all covenants, restrictions, easements, rights of way and reservations which may be a matter of record in the aforesaid Clerk’s Office or visible upon the ground, all prior liens and encumbrances, including, without limitation, liens for real estate taxes, incinerator, sanitary and sewer charges. The purchasers at the sale shall be responsible for paying the recording costs and also the tax on the privilege of transferring real property (the cost of the tax stamp to be affixed to the deed). The purchasers shall be responsible for payment of all real estate taxes.
The subject property will be sold in âAS ISã condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.
TERMS: $5000.00 in cash and/or certified funds as deposit with the balance due and payable within 30 days of the day of sale.
FEDERAL TAX LIEN: In the event that there are Federal Tax Liens against the property, the United States would have the right to redeem the property within a period of 120 days from the date of such sale or the period allowable for redemption under local law, whichever is longer.
Pursuant to the Deed of Trust, the Trustee may postpone the sale by public announcement at the time and place designated or by posting a notice of the same, and act by agent in the execution of the sale. The parties secured by the Deed of Trust reserve the right to purchase the property at such sale.
