NOTICE OF TRUSTEE’S SALE
NOTICE IS HEREBY GIVEN that, default having been made in the payment of the indebtedness secured by the deed of trust hereinafter described and the undersigned having been required so to do by the owner and holder of said indebtedness, the undersigned Substitute Trustee {see Book No. 2104, at page 158 thereof} will offer for sale at the front door of the Wood County Courthouse, Parkersburg, West Virginia, on TUESDAY, MARCH 31, 2020,
at 9:30 o’clock in the
forenoon, local time,
at public auction, to the highest bidder for cash, all of the right, title and interest of HARRY W. PITTS, JR., and MARY HELEN PITTS, husband and wife, in and to the real property described in a certain deed of trust dated October 19, 1994, to JAMES B. HAYHURST, JR., and STEVEN E. WILSON., original Trustees, recorded in the Office of the Clerk of the County Commission of Wood County, West Virginia, in General Lien Book No. 629, at page 701 thereof, possessed by the said HARRY W. PITTS, JR., and MARY HELEN PITTS as at the making of said deed of trust, which said real estate is described in said deed of trust as follows:
All of that certain lot, tract or parcel of real estate situate in the City of Parkersburg, County of Wood and State of West Virginia, more particularly described as follows:
BEGINNING at a nail set in the westerly line of Quincy Street, said point being the northeast corner of that certain tract conveyed by Richard D. Buttermore, et al, to James E. Kurucz and Desiree S. Kurucz, by deed dated the 1st day of December, 1992, of record in the Office of the Clerk of the County Commission of Wood County, West Virginia, in Deed Book 914, at page 255; thence leaving said street N. 66 degrees 38′ 05″ W. 234.26 feet to an iron rod reference at plat for James E. and Desiree S. Kurucz, of record in the aforesaid Clerk’s Office in Deed Book 914, at page 257; thence N. 24 degrees 51′ 39″ E. 87.59 feet to an iron rod; thence S. 62 degrees 41′ 17″ E., passing the end of Cornwall Street at 81.84 feet, for a total distance of 121.84 feet to an iron rod lying in the easterly line of said Cornwall Street; thence N. 27 degrees 18′ 43″ E. along said easterly line of Cornwall Street 17 feet to an iron rod; thence leaving said street S. 62 degrees 41′ 17″ E. 57.02 feet to a point; thence N. 27 degrees 18′ 43″ E. 1 foot to a point; thence S. 62 degrees 41′ 17″ E. 60 feet to a nail lying in the westerly line of above mentioned Quincy Street; thence along said Quincy Street S. 28 degrees 12′ 50″ W. 89.33 feet to the place of beginning, containing 0.48 acre, more or less, as shown on a plat dated August 30, 1994, attached hereto and marked for reference as Exhibit “A”.
BEING the same real estate conveyed unto Harry W. Pitts, Jr. and Mary Helen Pitts, husband and wife, by Leslie S. Buttermore, Trustee of the Leslie S. Buttermore Trust, by deed dated the 3rd day of October, 1994, and to be recorded herewith in the aforesaid Clerk’s Office.
This conveyance is made subject to any and all covenants, restrictions, reservations, agreements, exceptions, rights of way and easements of record,
AND believed to have a mailing address of 1011 Quincy Street, Parkersburg, West Virginia.
The following terms will apply to said sale, to-wit:
1. $2,500.00 in cash or certified funds at sale, with balance due by the close of business on the day of sale, or as the Trustee and bidder(s) may otherwise agree at sale.
2. Subject to conveyance made in Deed Book 1104, page 544.
3. Subject to any and all reservations, exceptions, conditions, grants of rights of way and easements made by the grantor and his predecessors in title prior to the granting of the deed of trust being foreclosed upon.
4. The undersigned reserves the right to adjourn the sale from day to day and time to time upon oral proclamation made at the time and place of sale set forth herein or at such later time and place to which the sale has theretofore been adjourned.
5. The undersigned reserves the right to reject any and all bids.
6. Sale is subject to unpaid ad valorem taxes and special assessments, if any, as well as any sale of the subject real estate for unpaid taxes.
7. The premises described hereinabove, including any and all improvements thereto, are sold “AS-IS WHERE IS” with no warranty express or implied.
8. The owner and holder of the indebtedness secured by the deed of trust described hereinabove reserves the right to bid at this sale.
9. The successful buyer at the sale will be responsible for paying any and all transfer stamps, excise fees and recording costs with respect to the trustee’s deed.
10. Neither the owner and holder of the indebtedness secured by the underlying deed of trust nor the substitute trustee shall have any duty to cause any existing tenant or person or persons occupying the subject property to vacate said property.
11. Any personal belongings remaining in the subject premises after sale shall be deemed abandoned and may thereafter be disposed of at the successful bidder’s or bidders’ discretion. Any person or entity claiming ownership of or any interest in any such property should contact the undersigned prior to sale about any such claim.
12. The successful bidder at the sale and the Trustee shall execute a Memorandum of Sale at the conclusion of the sale, and the terms of the Memorandum shall control.
13. In the event that the successful bidder at the sale fails or refuses to consummate his, her, its or their purchase, then the Trustee shall have the option to consummate sale with the next highest bidder at the sale.
