Defendants.
The object of this action is for this Court to determine the Petitionerás right to condemn and appropriate for said public purpose the land indicated and described herein; that the Court will permit said land sought to be condemned to be at once entered upon, possessed, appropriated and used, for the purposes stated in the Petition; that Commissioners be appointed to ascertain a just compensation to the owner or owners thereof, and other persons (lienors or otherwise) interested therein, for such land herein described and proposed to be taken, appropriated and used, for the public purposes and uses, aforesaid, together with damages, if any, to the residue of the respective tracts from which the said parcels sought to be acquired are respectively taken, beyond all benefits, if any, which may be derived in respect to such residue, for the purposes to which the parcels are to be taken, appropriated and used; that such other and further proceedings may be had in the premises as shall conform to the law, and that upon the payment of the compensation and damages thus or to be ascertained, a right of entry be issued; that land, may be vested in the Urban Renewal Authority of the City of Parkersburg, a public corporation, and that Petitioner may be granted such, other further, general and special relief in the premises as shall seem meet and proper to this Honorable Court.
The parcel of land subject to this proceeding is more particularly bounded and described as follows:
Situate in the City and District of Parkersburg, Wood County, West Virginia, commonly known as 1705 St Marys Avenue, and more particularly described as follows:
BEING what is known as 1705-1705 ¢ St. Marys Avenue, Parkersburg, West Virginia; BEGINNING at a point in the westerly line of St. Marys Avenue, which said point is 54 feet northerly measured along St. Marys Avenue from the northerly line of 17th Street and St. Marys Avenue; thence with said Avenue in a northerly direction 40 feet to a point; thence at right angles and in a westerly direction 133.75 feet to the easterly line of a 20-foot alley; thence with the line of said alley in a southerly direction 40 feet to a point; thence at right angles and in an easterly direction 133.75 feet to the place of beginning, being part of Lot No. 7 of William Bentleyás Addition to Parkersburg, a plat of which said Addition is of record in the Office of the Clerk of the County Commission of Wood County, West Virginia, in Deed Book 49, at page 323.
BEING the same real estate conveyed unto Archipelago Properties, LLC, a Delaware corporation, by Quitclaim Deed from American Pride Properties, LLC, a Delaware corporation, dated November 30, 2016, and recorded in the aforesaid Clerkás Office in Deed Book 1257, at page 802.
This conveyance is made subject to such rights of way, easements, reservations, restrictions, covenants, conditions, out-conveyances and leases as the same may be contained in prior deeds of record in the chain of title.

It appearing by Affidavit filed in this action that the last known address(es) for Defendant Linda Jo Philpott Sheppard and for any unknown person(s) who may have an interest are unknown and that no other address(es) of residency(ies) are known, it is hereby ordered that Defendant(s) Linda Jo Philpott Sheppard and any unknown person(s) serve upon Robert K. Tebay III, Assistant City Attorney, City of Parkersburg, whose address is Post Office Box 1627, Parkersburg, West Virginia, 26102, an Answer, including any related counterclaim or defense you may have to the Petition filed in this action on or before the 8th day of July, 2019. If you fail to do so, thereafter judgment, upon proper hearing, may be taken against you for the relief demanded in the Petition.
A copy of said Petition can be obtained from the undersigned Clerk at her office.
