NOTICE OF TRUSTEEáS SALE
NOTICE OF TRUSTEE’S SALE is hereby given pursuant to and by virtue of the authority vested in the Substitute Trustee, Pill & Pill, PLLC, by that certain Deed of Trust dated June 12, 2014, executed by the Borrower, Luca Pennisi, to John E. Dorsey, the Trustee, of record in the Office of the Clerk of the County Commission of Wood County, West Virginia, in Book 1823, at Page 131. At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 535 Kittle St., Williamstown, WV 26187. Pill & Pill, PLLC was appointed as Substitute Trustee by an APPOINTMENT OF SUCCESSOR TRUSTEE dated September 1, 2016, of record in the Clerk’s Office in Book 1937, at Page 126. The Borrower defaulted under the Note and Deed of Trust and the Substitute Trustee has been instructed to foreclose under the Deed of Trust. Accordingly, the Substitute Trustee will sell the following described property to the highest bidder at the front door of the Courthouse of Wood County, in Parkersburg, West Virginia, on the following date:
November 2, 2016 at 5:34 p.m.
All that certain lot, tract or parcel of land, together with the improvements thereon and the appurtenances thereunto belonging situate in Union District, Wood County, West Virginia, and being more particularly described as follows:
BEGINNING at an iron pin in the northerly line of Kittle Street, which is S. 88õ 47á E., 2,785.25 feet from the northeast corner of the intersection of Beckwith Avenue and Kittle Street; and which iron pin is the southeasterly corner of a tract of land heretofore conveyed unto William G. Mason and Linda J. Mason, husband and wife, by Deed dated the 24th day of August, 1978, and of record in the Office of the Clerk of the County Commission of Wood County, West Virginia, in Deed Book 713, at page 506; thence with the easterly line of said Mason tract of land N. 1õ 13’ E., 200 feet to an iron pin which is the northeasterly corner of the Mason tract of land; thence S. 88õ 47á E., 100 feet to an iron pin; thence S. 1õ 13á W., 200 feet to a point in the northerly line of said Kittle Street; thence with the northerly line of said Kittle Street N. 88õ 47á W., 100 feet to the place of beginning, containing 0.459 acre, more or less;
SUBJECT TO and TOGETHER WITH those certain covenants and restrictions of record in Deed dated April 17,1995, by and between John M. Negley, Jr. and Debra M. Negley, of record in the aforesaid Clerkás Office, in Deed Book 942, at page 663.
SUBJECT TO and TOGETHER WITH that certain easement and right of ingress and egress over the areas designated as Kittle Street, Beckwith Avenue, and Rita Road, the road to West Virginia Highway No. 31, more particularly described in Deed dated April 17, 1995, by and between John M. Negley, Jr. and Debra M. Negley, of record in the Office of the Clerk of the County Commission of Wood County, West Virginia, in Deed Book 942, at page 663.
Being the same property conveyed unto Michael D. Barnes and Katrina R. Barnes, by Deed dated December 14, 2006, by Prudential Relocation, Inc., of record in the Office of the Clerk of the County Commission of Kanawha County, West Virginia, in Deed Book 1107, at page 572
AND BEING the same property conveyed to Luca Pennisi by the Deed dated June 12, 2014 and recorded in Deed Book 1216, at Page 179, in the Office of the Clerk of the County Commission of Wood County, West Virginia.
TERMS OF SALE:
1) The property will be conveyed in an âAS ISã physical condition by Deed containing no warranty, express or implied, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights-of-ways, easements, covenants, conveyances and conditions of record in the Clerkás office or affecting the subject property.
2) The Purchaser shall be responsible for the payment of the transfer taxes imposed by the West Virginia Code Œ 11-22-1.
3) The Beneficiary and/or the Servicer of the Deed of Trust and Note reserve the right to submit a bid for the property at sale.
4) The Trustee reserves the right to continue sale of the subject property from time to time by written or oral proclamation, which continuance shall be in the sole discretion of the Trustee.
5) The Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, and any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY.
6) The total purchase price is payable to the Trustee within thirty (30) days of the date of sale, with ten (10%) of the total purchase price payable to the Trustee at sale.
