NOTICE OF FINDING OF NO SIGNFICANT IMPACT AND NOTICE OF INTENT TO REQUEST RELEASE OF FUNDS

These notices shall satisfy two separate but related procedural requirements for activities to be undertaken by the WVHDF.
REQUEST FOR RELEASE OF FUNDS
On or after March 18, 2019 the WVHDF will submit a request to the HUD for the release of HOME Investment Partnerships Program funds under Title II of the Cranston Gonzalez National Affordable Housing Act of 1990, as amended, to undertake the following project:
Project Name: Murdoch Heights Apartments
Purpose: Acquisition and New Construction of Murdoch Heights Apartments, a 50-unit affordable rental housing
project seniors.
Location: 1602 Murdoch Avenue, Parkersburg, Wood County, WV 26101
Estimated Cost: Estimated HOME funding up to $1,345,000 and estimated total project cost up to $8,112,300.
FINDING OF NO SIGNIFICANT IMPACT
The WVHDF has determined that the project will have no significant impact on the human environment. Therefore, an Environmental Impact Statement under the National Environmental Policy Act of 1969 (NEPA) is not required. PUBLIC COMMENTS
Any individual, group, or agency may submit written comments on the ERR to the WVHDF at the above address or at environmental@wvhdf.com. All comments received by March 17, 2019 will be considered by the WVHDF prior to authorizing submission of a request for release of funds. Comments should specify which Notice they are addressing.
RELEASE OF FUNDS
The WVHDF certifies to HUD that Erica L. Boggess in her capacity as Executive Director consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied. HUD’s approval of the certification satisfies its responsibilities under NEPA and related laws and authorities and allows Murdoch Heights Apartments LP to use HUD program funds.
OBJECTIONS TO RELEASE OF FUNDS
HUD will accept objections to its release of fund and the WVHDF’s certification for a period of fifteen days following the anticipated submission date or its actual receipt of the request (whichever is later) only if they are on one of the following bases: (a) the certification was not executed by the Certifying Officer of the WVHDF; (b) the WVHDF has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR part 58; (c) the grant recipient or other participants in the development process have committed funds, incurred costs or undertaken activities not authorized by 24 CFR Part 58 before approval of a release of funds by HUD; or (d) another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality. Objections must be prepared and submitted in accordance with the required procedures (24 CFR Part 58, Sec. 58.76) and shall be addressed to HUD at U. S. Department of Housing and Urban Development, Moorehead Federal Building, 1000 Liberty Avenue, Suite 1000, Pittsburgh, PA 15222-4004. Potential objectors should contact HUD to verify the actual last day of the objection period.

The object of the above entitled action is To obtain judgment in the amount of $296.32 plus court cost and interest from judgment date, for fire protection, sanitation and police fees under the Codified Ordinances of the City Of Parkersburg plus interest through 12-31-18 and court cost.
And it appearing by an affidavit filed in this action that the plaintiff has used due dilligence to ascertain the residence or whereabouts of the defendant without effect.
It is ordered that the defendant do serve upon Joe Kuhl, magistrate, whose address is 401 2nd Street, Suite 12, Parkersburg, WV 26101, an answer or other defense to the complaint filed in this action on or before 3-29-19, otherwise judgment by default will be taken against the defendant at any time thereafter. A copy of said complaint can be obtained from the undersigned Clerk of her office.
