LEGAL NOTICE

 

In accordance with Article 1761 of the Codified Ordinances of the City of Williamstown, the persons named below are hereby notified that the Building Safety Commission of the City of Williamstown may, at any time on or after January 1, 2019, enter upon that certain property located at 904 Highland Avenue, Williamstown, West Virginia, for the purpose of demolition of the stucture located thereon, all in accordance with an Order of the Building Safety Commission entered on October 23, 2018, as follows:

ORDER

 

       RE:   BUILDING LOCATED AT 904 HIGHLAND AVE                                 WILLIAMSTOWN, WOOD COUNTY, WEST

               VIRGINIA

TO:  EVERETTE W. ANDERSON, JR., EXECUTOR OF THE ESTATE OF NAOMI ANDERSON, DECEASED, MICHAEL MCGURDY, JEFFREY MCGURDY, JOSEPH MCGURDY, THOMAS MCGURDY, JOE MCGURDY, GREGORY HOLDREW, KAREN BURTON, CHRISTINE SLOTER, JOANNA LUPARDUS, JACK ANDERSON, SUE ANN ANDERSON, GEORGE R. BATEMAN, DAVID BATEMAN, BARBARA HONTZ, JAMES BATE             MAN, REBECCA YAKIM

 

At a meeting held on September 26, 2018, the Building Safety Commission of the City of Williamstown, West Virginia, determined that the building upon property located at 904 Highland Avenue, Williamstown, Wood County, West Virginia, is unfit for human habitation and is unsafe, unsanitary, dangerous and detrimental to the public safety and welfare. It is therefore ORDERED that the owners of said building cause the same to be demolished and all debris removed by December 31, 2018, or to maintain and repair the same in such a manner that the condition of said building meets all of the requirements of the West Virginia State Building Code, likewise to be accomplished by December 31, 2018.

 

You are further notified that in accordance with the provisions of Article 1761 of the Codified Ordinances of the City of Williamstown, West Virginia, that if you fail to comply with the provisions of this Notice, the City of Williamstown may cause the building herein described to be demolished, and that a lien may be placed upon your real property for the cost of such demolition and attendant attorney fees and costs.

 

You are further notified of the following:

 

  1. You have the right to request a hearing before the Building Safety Commission, provided such request be made in writing by November 30, 2018; and
  2. You have the right to apply to the Circuit Court of Wood County, West Virginia, for a temporary injunction or other similar relief restraining action by the City of Williamstown, provided that such application be filed by December 21, 2018.
