NOTICE OF TRUSTEES’ SALE

Pursuant to the authority vested in the undersigned Trustees, by a Deed of Trust dated the 19th day of March, 2014, executed by Cora J. Sams, to James C. Gardill, Trustee, which said Deed of Trust is of record in the Office of the Clerk of the County Commission of Wood County, West Virginia, in Deed of Trust Book No. 1811, at Page 589.

 

Cora J. Sams has defaulted under the terms of the Promissory Note secured by the Deed of Trust. The debt evidenced by the Promissory Note has therefore been accelerated by the lender, Wesbanco Bank, Inc.

 

At the request of the beneficiary, holder, and owner of the Deed of Trust, the undersigned Trustee, through his agent, will sell at public auction to the highest bidder at 1:00 p.m., on the 17th day of July, 2018, on the steps of the Wood County Courthouse in Parkersburg, West Virginia, the following described real estate:

 

Lying and being situate in the City of Parkersburg, Wood County, West Virginia, and more particularly described as follows:

 

BEING all of Lot No. Seventy-Two (72) of Fischer and Straus’s South Parkersburg Addition, as shown and described on a plat of said Addition of record in the Office of the Clerk of the County Commission of Wood County, West Virginia, in Deed Book No. 61, at page 274.

 

BEING the same real estate conveyed unto Carl J. Sams and Cora J. Sams, husband and wife, by Deed from Harold Edwin Moore and Jean L. Moore, husband and wife, dated July 29, 1965, and of record in the aforesaid Clerk’s Office in Deed Book 504, at page 638. The said Carl J. Sams died December 23, 2005, and by the joint and survivorship provision of the last-mentioned Deed Cora J. Sams became vested with the entire fee simple interest in said real estate.

 

PRIOR INSTRUMENT REFERENCE: Deed Book 504, Page 638, Records of the Office of the Clerk of the County Commission of Wood County, West Virginia.

 

The above-described property is reported to have a mailing address of or is commonly known as: 2110 10th Avenue, Parkersburg, WV 26101.

 

The real estate will be sold subject to real estate taxes assessed against the real estate, zoning regulations, prior Deeds of Trust, judgment liens, leases, including, but not limited to, oil, gas, and mineral leases, restrictions, rights-of-way, reservations, protective covenants, delinquent fees, rates and charges of any public service district, recorded or unrecorded, public utility easements and easements of record affecting the real estate.

 

The property is sold subject to those facts which might be disclosed by visual examination, survey, title examination or environmental audit.

 

It is the intention of this notice to sell the secured property by proper description as was intended to be transferred and conveyed in the aforesaid Deed of Trust.

 

TERMS OF SALE: Cash in hand on day of sale or 10% down on the day of sale and full payment within 14 days of the date of sale. Failure to tender the remaining balance of the purchase price to the Trustees within 14 days shall constitute a forfeiture of the buyer’s bid as if it were null and void and said purchaser’s down payment shall be forfeited to the Trustees for costs of sale.  The Trustees does not want title to this property.

 

Any sale hereunder may be adjourned from time to time without any notice other than oral proclamation at the time and place appointed for this sale or by posting of a notice of same. Should the Trustees not appear at the time appointed for the sale and there is no notice posted of a continuance, please contact Wesbanco Bank, Inc., Attention: Mary Lufft, at 304.243.7581. Any sale may be conducted or adjourned by the designated agent or attorney of the Trustees. The Trustees are fully vested with the authority to sell the property as the Trustees by instrument to be recorded.
