The undersigned will offer for sale, by public auction on Wednesday , the 26th day of Oct., 2016, at 10:00 oáclock a. m., at the front door of the Wood County Courthouse, the following parcel of real estate formerly owned by Ethel Bell, now deceased, located on Lost Pavement Road in Tygart District, Wood County, West Virginia, free of liens and claims, and more particularly described as follows:
DESCRIBED AS TYGART DISTRICT TAX MAP 80 PARCELS âTã AND âUã.
FIRST TRACT: Beginning at a stone corner to A. Kesterson in the line of Schleicher, thence N. 14 E. 7 3/11 poles to a stone in the line of A. Kesterson; thence S. 73 E. 25 poles to a stone on the side of the County Road; thence S. 5 E. 7 poles and 22 1/2 links to a stone on the side of County Road; thence N. 73 W. 27 poles and 16 1/2 links to the place of beginning, containing one acre and 32 and 37/100 square rods, more or less.
SECOND TRACT: Beginning at a pipe driven on the western side of the County Road and 4 poles and 61/2 links southward from the S.W. corner of a concrete bridge, thence along the west side of said road S. 1 degree 10 minutes E. 7.2 poles to a post; thence with a line of the first tract above described N 72 40á W. 24.2 poles to a stake by a post; thence N. 15 E. 7 poles to a stake; thence S. 70 40á E. 22.08 poles to the place of beginning, containing one acre and one and 98/100 square rods, more or less.
Terms of sale:
The above property is being sold by the undersigned under the authority of an Order Entered in the Circuit Court of Wood County, West Virginia CA No. 2015-C-344. Roger Bell et. al. v. Sherrie Bell et. al. The sale will be free of liens and claims, except for any real estate taxes owed, or to be owed thereon. Provided however, the sale will be subject to any and all rights of way, easements, reservations, and restrictions of record. The undersigned will require a deposit of at least 10% of the purchase price as of the day of sale by good funds. The balance of the purchase price shall be paid within 30 days of sale. In the full purchase price is not timely paid, the deposit will be forfeited as liquidated damages to cover the costs of re-sale. The sale is subject to the final approval of the Circuit Court of Wood County.
