RENEWAL OF CLASS D GENERAL PERMIT

NONCOMMERCIAL CONSTRUCTION/DEMOLITION

SOLID WASTE FACILITY

The West Virginia Department of Environmental Protection (DEP), Division of Water and Waste Management, hereby proposes the renewal of the Class D General Permit, Permit Number SWF-GP-NC-CLASS D, which regulates the activities of a Class D Solid Waste Facility. The Class D Solid Waste Facility, a noncommercial construction/ demolition disposal area no greater than two (2) acres in spacial area in which the height of construction/ demolition material may not exceed the height of the adjoining ground elevation, is defined by 33CSR1 âSolid Waste Management Ruleã. The Class D General Permit will be issued for a five (5) year term.

 

The Director of the Division of Water and Waste Management retains authority to require any registrant to obtain an individual solid waste permit. This authority will be exercised when the Director determines that such individual permit will better protect human health and/or the environment.

 

Interested persons may submit written comments during the 30-day public comment period, which begins on September 13, 2016 and ends on October 13, 2016, to the following address:

Comments received within this time period will be considered prior to any state action on the subject permit. Correspondence should include the name, address, and telephone number of the writer and a concise statement of the nature of the issues addressed.

 

A public hearing may be held if the DEP identifies a significant degree of public interest on issues relevant to the DRAFT permit. To obtain further information concerning the subject application, or to request a public hearing, interested persons may contact the Division of Water and Waste Management during the public comment period at the above address.

 

The draft permit will be on file for public review during the comment period at the West Virginia Department of Environmental Protection, 601 57th St. SE, Charleston, WV 25304.
