NOTICE OF TRUSTEEáS SALE
NOTICE OF TRUSTEE’S SALE and Notice of the Beneficiary/Servicer’s election to sell property, is hereby given pursuant to and by virtue of the authority vested in the Trustee(s) by that certain Deed of Trust dated February 12, 2009, executed by Pamela J. Wenmoth and R. Thomas Wenmoth to Scott A. Smith, Trustee, of record in the Office of the Clerk of the County Commission of Wood County, West Virginia, in Book 1538, at Page 744. Bailey & Slotnick, PLLC was appointed as Trustee by APPOINTMENT OF SUCCESSOR TRUSTEE dated January 10, 2018, of record in the Clerk’s Office in Book 2004, at Page 404. The borrowers defaulted under the Note and Deed of Trust and the Trustee has been instructed to foreclose under the Deed of Trust. Accordingly, the Trustee will sell the following described property to the highest bidder at the front door of the Courthouse of Wood County, in Parkersburg, West Virginia, on:
TUESDAY, FEBRUARY 13, 2018, AT 10:20 O’CLOCK A.M.
All those certain lots or parcels of land, together with the improvements thereon and appurtenances thereunto belonging, situate in Lubeck District, Wood County, West Virginia, and more particularly bounded and described as follows, to wit:
Being all of Lots Nos. 103, 104, 105 and 106 of DuPont Manor as shown on a revised plat of said addition recorded in the Office of the Clerk of the County Commission of Wood County, West Virginia, in Plat Book No. 12, at page 19, to which plat reference is hereby made for a more particular description of said lots. Said lots are shown as Lots Nos. 110, 111, 112 and 113, respectively on the original plat of DuPont Manor, said plat being recorded in said Clerkás Office in Plat Book No. 8, at page 66.
There is excepted and not conveyed hereby all of Lot No. 103 and part of Lot No. 104, containing 9,094 square feet; out conveyed by deed dated April 4, 1972, recorded in the Clerkás Office in Deed Book No. 597, at Page 409.
At the time of the execution of the Deed of Trust, this property was reported to have an address of: 81 Sunset Blvd., Parkersburg, WV 26101.
This is the same property conveyed unto R. Thomas Wenmoth and Pamela J. Wenmoth by deed dated May 7, 1987, of record in Clerk’s Office in Book 848, at Page 432.
TERMS OF SALE:
1) The property will be conveyed in an âAS ISã physical condition by Deed containing no warranty, express or implied, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights-of-ways, easements, covenants, conveyances and conditions of record in the Clerkás office or affecting the subject property.
2) The Purchaser shall be responsible for the payment of the transfer taxes imposed by the West Virginia Code Œ 11-22-2.
3) The Beneficiary and/or the Services of the Deed of Trust and Note reserve the right to submit a bid for the property at sale.
4) The Trustee reserves the right to continue sale of the subject property from time to time by written or oral proclamation, which continuance shall be in the sole discretion of the Trustee.
5) The Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate the property, and any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY.
6) The total purchase price is payable to the Trustee by cashier’s check, cash or the equivalent within thirty (30) days of the date of sale, with ten percent (10%) of the total purchase price payable to the Trustee at sale by cashier’s check, cash or the equivalent.
