NOTICE OF PUBLIC HEARING
FOR THE BOARD OF COUNTY COMMISSIONERS OF WOOD COUNTY, WEST VIRGINIA
WITH RESPECT TO
AN AMOUNT NOT TO EXCEED
$5,500,000 OF PUBLIC FINANCE AUTHORITY
REVENUE BONDS, SERIES 2017A
(ACE EDUCATIONAL FOUNDATION, INC. PROJECT)
Notice is hereby given that on December 18, 2017, a public hearing, as required by Section 147(f) of the Internal Revenue Code of 1986, as amended (the âCodeã), will be held by the Board of County Commissioners of Wood County, West Virginia (the âCountyã) with respect to the proposed issuance by the Public Finance Authority of the State of Wisconsin (the âAuthorityã) of its Revenue Bonds, Series 2017A (ACE Educational Foundation, Inc. Project) in one or more series (the âBondsã), in an amount not to exceed $5,500,000. The hearing will commence at 9:30 a.m., or as soon thereafter as the matter can be heard, and will be held at the offices of the County at the Wood County Courthouse, 1 Court Square, Suite 203, Parkersburg, West Virginia 26101.
The following information was provided by the Authority for this Notice:
- The Bonds are expected to be issued pursuant to Section 66.0304 of the Wisconsin Statutes, as amended, by the Authority, a commission organized under and pursuant to the provisions of Sections 66.0301, 66.0303 and 66.0304 of the Wisconsin Statutes, as amended.
- The proceeds from the sale of the Bonds will be loaned to the Borrower identified below and used for the Project identified below.
- The Bonds will be limited obligations of the Authority payable solely from the loan repayments to be made by the Borrower to the Authority, and certain funds and accounts established by a financing agreement for the Bonds.
The following information was provided by ACE Educational Foundation, Inc., a New York nonprofit corporation (the âBorrowerã), for this Notice:
- The Borrower will use the proceeds of the Bonds to (i) acquire a gasifier license from Ohio Valley University; (ii) acquire approximately 60 acres of land at 120 29th Street, in Parkersburg, West Virginia; (iii) pay predevelopment, engineering, design and consulting costs relating to a planned coal gasification plant and educational facility for production and management of clean energy on the Site; and (iv) pay the costs of issuance of the Bonds (collectively, the âProjectã).
- The Project will initially be owned and operated by the Borrower and/or its wholly owned subsidiary.
The hearing will provide a reasonable opportunity to be heard for persons wishing to express their views on the merits of the Project, its location, the issuance of the Bonds or related matters. Written comments will be accepted by the County at 1 Court Square, Parkersburg, West Virginia 26101, but must be received on or before the time and date of the hearing. The Wood County Courthouse is accessible to individuals with disabilities. With twenty-four (24) hour advance request, a sign language interpreter may be made available by calling (304) 424-1976. Assistive listening devices are available upon request at the staff table.
