The undersigned Substitute Trustee, by virtue of the authority vested in him by that certain Deed of Trust, dated June 16, 2008, and duly recorded in the Office of the Clerk of the County Commission of Wood County, West Virginia, in Document No. 573287, in Book No. 1498, at Page 770, Angela Dowler did convey unto Norman L. Folwell, Esq, Trustee(s), certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Seneca Trustees, Inc., as Substitute Trustee by a Substitution of Trustee dated July 29, 2016 and recorded in the aforesaid Clerk’s office; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by Selene Finance LP to foreclose thereunder, will offer for sale at public auction at the front door  of the Wood County Courthouse in Parkersburg, West Virginia, on

the following described real estate, together with its improvements, easements and appurtenances thereunto belonging, situate in Parkersburg District, Wood County, West Virginia, and more particularly described as follows:

 

Situate in the City of Parkersburg, County of Wood, and State of West Virginia, more particularly bounded and described as follows:

BEGINNING at a point in the Northerly line of Thirty-Sixth Street, distant 328.3 feet Westerly from the Westerly line of Willard Street, at the common corner of Lots Nos. Twelve and Thirteen of the Addition hereinafter named; thence with the said line of Thirty-Sixth Street, in a Westerly direction Fifty (50) feet to the common corner of Lots Nos. Eleven and Twelve of said Addition; thence with the common line of said lots, in a Northerly direction 192.15 feet to the Southerly line of Thirty-Seventh Street; thence with said line in an Easterly direction 50 feet to another common corner of said Lots Nos. Twelve and Thirteen; thence with the common line of said Lots in a Southerly direction, 191.94 feet to the point of beginning, and being all of Lot No. Twelve (12). Block One (1), Shattuck Heights Addition to the City of Parkersburg, Wood County; West Virginia, a Plat of which said Addition is of record in the Office of the Clerk of the County Court of Wood County, West Virginia, in Plat Book No. 3 at page 11, to which said Plat reference is hereby had and made for a more particular description of said lot.

There is EXCEPTED AND RESERVED unto Joseph Martin and Tracey Martin a conveyance recorded in Book 1095 at Page 886, which is described as follows:

Beginning at an iron pipe (found) in the southerly right of way line of 37th Street, the northerly common corner of Lots (11) and (12) of Shattuck Heights Addition (Plat Book 3, Page 11).

Thence: with the Southerly right of way line of said 37th Street, S. 54õ 55á E. 50.00 feet to an iron rod (found). The northerly common corner of Lots (12) and (13) of said addition.

Thence: with the common line of said lots (12) and (13), S. 35õ 00á W 99.82 feet to an iron rod (set).

Thence with the interior of said Lot (12), N 56õ 00á W 50.00 feet to an iron rod (set) in the common line of said lots (11) and (12).

Thence: with the common line of said Lots (11) and (12). N 35õ00á E. 100.03 feet to the point of beginning and containing 5,000 square feet more or less.

Being part of Lot (12) of Shattuck Heights Addition (Plat Book 3, Page 11).

 

Being the same property conveyed unto Don Maloney, III and Julia B. Maloney, by deed dated October 10, 2002 and of record in the Office of the Clerk of the County Commission of Wood County, West Virginia, in Deed Book No. 1046, at page 450.  Also being the same property conveyed unto Wyolene Britton, by deed dated June 19, 1961, of record in the aforesaid Clerkás office in Deed Book 457, at page 19.

 

At the time of the execution of the Deed of Trust, this property was reported to have an address of: 1115 36th Street, Parkersburg, WV 26104.

 

The referenced real estate will be conveyed with no covenants of warranty, and subject to all covenants, restrictions, easements, rights of way and reservations which may be a matter of record in the aforesaid Clerk’s Office or visible upon the ground, all prior liens and encumbrances, including, without limitation, liens for real estate taxes, incinerator, sanitary and sewer charges. The purchasers at the sale shall be responsible for paying the recording costs and also the tax on the privilege of transferring real property (the cost of the tax stamp to be affixed to the deed). The purchasers shall be responsible for payment of all real estate taxes.

The subject property will be sold in âAS ISã condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.

TERMS: $5,000.00 in cash and/or certified funds as deposit with the balance due and payable within 30 days of the day of sale.

FEDERAL TAX LIEN: In the event that there are Federal Tax Liens against the property, the United States would have the right to redeem the property within a period of 120 days from the date of such sale or the period allowable for redemption under local law, whichever is longer.

Pursuant to the Deed of Trust, the Trustee may postpone the sale by public announcement at the time and place designated or by posting a notice of the same, and act by agent in the execution of the sale. The parties secured by the Deed of Trust reserve the right to purchase the property at such sale.
