NOTICE OF TRUSTEE’S SALE is hereby given pursuant to and by virtue of the authority vested in the Substitute Trustee, WV Trustee Services, LLC, by that certain Deed of Trust dated January 31, 2007, executed by Borrower(s), Herbert A Whitlatch and Nancy S Whitlatch, to Stephen L. Thompson, the Trustee of record in the office of the Clerk of the County Commission of Wood County, West Virginia, in Book 1410, at Page 652. At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 9194 Wadesville Road, Mineral Wells, WV 26150. WV Trustee Services, LLC were appointed as Substitute Trustees by APPOINTMENT OF SUCCESSOR TRUSTEE dated July 17, 2017, of record in the Clerk’s Office in Book 1980, Page 353. The borrower(s) defaulted under the Note and Deed of Trust and the Substitute Trustees have been instructed to foreclose under the Deed of Trust. Accordingly, the Substitute Trustees will sell the following described property to the highest bidder at the front door of the Courthouse of Wood County, in Parkersburg, West Virginia, on the following date:

Jackson line N. 2õ 3’ 03’ E. 2,566 feet to a set iron pipe, former to Phillip S. Jackson, et al; thence continuing with Jackson line N. 71õ 53’ E. 422.5 feet to a 14ã Buckeye Tree, corner to Charles Hall; thence with two lines of Hall N. 84õ 38’ E. 363.7 feet to a set iron rod, S. 80õ E. 231 feet to a set iron rod; thence N. 68õ E. 861 feet to the center of Lee Creek Road; thence with the center line of Lee Creek Road the following courses: S. 17õ 06’ W. 410 feet to a point, S. 13õ 07’ W. 111 feet to a point, S. 9õ 04’ E. 199.5 feet to a point, S. 13õ 32’ E. 603 feet to a point, S 12 14 E. 115 feet to a point S. 28õ 37’ E. 66.5 feet to a point, S. 14õ 06’ E. 122.8 feet to a point, S. 45õ 21’ E. 575 feet to a point, S. 46õ 19’ E. 665 feet to a point, S. 34õ 11’ E. 146.4 feet to appoint, S. 23õ 03’ E. 120 feet to a point, S. 10õ 04’ E. 245.8 feet to a point, S. 20õ 23’ E. 118.3 feet to a point thence S. 39õ 20’ E. 101.3 feet to the place of beginning, containing 210.20 acres, as shown by survey and plat made by Paul N. Cochran, West Virginia L.L.S. #48, dated April 6, 1993, said plat attached hereto and made a part of hereof.
BEING the same property conveyed unto the Grantors herein by John S. Amos and Iris B. Amos, husband and wife, by Deed dated April 28, 1958, recorded in the Office of the Clerk of the County Commission of Wood County, West Virginia, in Deed Book No. 419, at page 503.
This conveyance is subject to any and all easements, rights of way and reservations that may now appear of record and particularly, EXCEPTING 3/16th of all mineral, coal, oil and gas or other ores as heretofore reserved, as well as, a cemetery parcel that may be a part of the above-described parcel.
It is agreed by and between the parties hereto that the 1993 taxes will be prorated on a calendar basis by the parties hereto as of the date of the execution of this document.
Being the same property conveyed to Herbert A Whitlatch and Nancy S Whitlatch by the Deed dated April 27, 1993 and recorded in Deed Book 918 at Page 927 in the Office of the Clerk of the County Commission of Wood County, West Virginia.
TERMS OF SALE:
1) The property will be conveyed in an âAS ISã physical condition by Deed containing no warranty, express or implied, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights-of-ways, easements, covenants, conveyances and conditions of record in the Clerkás office or affecting the subject property.
2) The Purchaser shall be responsible for the payment of the transfer taxes imposed by the West Virginia Code Œ 11-22-1.
3) The Beneficiary and/or the Servicer of the Deed of Trust and Note reserve the right to submit a bid for the property at sale.
4) The Trustee reserves the right to continue sale of the subject property from time to time by written or oral proclamation, which continuance shall be in the sole discretion of the Trustee.
5) The Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, and any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY.
6) The total purchase price is payable to the Trustee within thirty (30) days of the date of sale, with ten (10%) of the total purchase price payable to the Trustee at sale.
