NOTICE OF TRUSTEEáS SALE
Pursuant to the authority vested in the undersigned J. Patrick Jones, Substitute Trustee by Notice of Substitution of Trustee which notice is of record in the Office of the Clerk of the County of Commission of Wood West Virginia, and by Deed of Trust dated September 15, 2006, executed by Michael Ferguson to BB&T Collateral Service Corporation, Trustee, which deed of trust is of record in the Office of the Clerk of Wood County, West Virginia, in Trust Deed Book 1384 at Page 878, the undersigned Substitute Trustee has been requested, in writing, by the beneficiary of said deed of trust to sell the real estate described below, as there has been a default under the terms and conditions of said deed of trust. Therefore, the undersigned Substitute Trustee will sell the real estate described in the Deed of Trust, at a public auction on September 23, 2016 at 3:00 p.m. to the highest bidder at the front door of the Courthouse of said County of Wood, in Parkersburg, West Virginia, which real estate is more completely described as follows:
All of that certain lot, tract or parcel of land lying and being situate in the District of Harris, County of Wood, and State of West Virginia, and more particularly described as follows:
BEGINNING at a point on the southerly right of way of State Route 68 at the northeast corner of Tract âD-2ã, conveyed unto Jodi Nelson as recorded in Deed Book 1031, on Page 76, where a bent pipe found bears N. 09 15’ 13ã W. a distance of 1.29 feet, said point being 90 feet right of centerline station 616+16.12, West Virginia Department of Transportation Project 3825-B; thence leaving said right of way and along the east line of Tract âD-2ã, S. 09 15’ 13ã W. a distance of 349.53 feet to a pipe found at the southeast corner of Tract âD-2ã, thence S 82 35’ 52ã W. a distance of 185.87 feet to a pipe found at the southwest corner of Tract âD-2ã, thence S. 24 41’ 49ã E. a distance of 517.41 feet to a 5/8ã rebar set at the southwest corner of Tract âDã; thence along the south line of Tract âDã, N. 51 24’ 27ã E. a distance of 835.72 feet to a 5/8ã rebar set; thence along a new division line, N. 40 29’ 58ã W. a distance of 255.84 feet to a 5/8ã rebar set; thence N. 73 28’ 07ã W. a distance of 109.11 feet to a 5/8ã rebar set; thence N. 33 20’ 54ã W. a distance of 244.09 feet to a 5/8ã rebar set on the southerly right of way line of State Route 68, 50 feet right of centerline station 613+69.07 feet; thence along said right of way, S. 72 40’ 00ã W. a distance of 30.93 feet to a point 50 feet right of centerline station 614+00; thence S. 17 20’ 00ã E. a distance of 40.00 feet to a point 90 feet right of centerline station 614+00; thence S. 72 40’ 00ã W. a distance of 216.12 feet to the point of beginning, containing 9.0704 acres, more particularly shown on the plat of survey made by Charles F. Hughes, Jr., Professional Surveyor No. 872, dated November 12, 2004.
This conveyance is made subject to all rights of way, or easements of record in favor of Monongahela Power Company, American Telephone and Telegraph Company, C & P Telephone Company, and to existing leases for oil, gas purposes.
TERMS OF SALE
- Cash in hand paid on the day of sale.
- The sale of the property will be made subject to all matters having priority over the deed of trust referred to herein including but not limited to any and all assessments and taxes against said property, all prior liens, encumbrances, lease, restrictions, covenants, conditions, right of ways and easements of any nature whatsoever.
- The purchaser shall be responsible for the payment of the transfer taxes imposed by West Virginia Code ç 11-22-2.
- The subject property will be sold in âAS ISã condition. The Substitute Trustee makes no representations and warranties of any kind or character including, but not limited to, the condition of the real estate or the title to the real estate to be conveyed.
- The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.
- The Substitute Trustee reserves the right to adjourn the sale, for a time, or from time to time, without further notice by announcement at the time and place of the sale described above.
- The beneficiary of the Deed of Trust and holder of the note thereby secured reserves the right to submit a bid for the property at the sale, which bid may be in the form of a credit bid.
- Such other terms as may be announced at the time of Sale.
