Upon Plaintiffás Affidavit for Service by Publication sworn to on July 3, 2017, and it satisfactorily appearing therefrom that service by publication on Defendant Joshua Clay Smith is authorized by Rule 4(e)(1) of the West Virginia Rules of Civil Procedure (ãWVRCPã), it is hereby ORDERED that publication of service in the above-styled action shall be made on Defendant Joshua Clay Smith by publishing the same in the Parkersburg News, a newspaper of general circulation published in Wood County, West Virginia, hereby designated as the newspaper most likely to give Defendant actual notice of the action. Pursuant to Rule 4(e)(1) of the WVRCP, âsuch order of publication shall be published once a week for two successive weeks.ã On or before August 16, 2017, Defendant shall appear, defend, and serve upon Andrew C. Shaffer, Plaintiffás attorney whose address is 103 Pennsylvania Avenue, Charleston, WV 25314, an Answer, including any related counterclaim he may have, to the Civil Complaint filed in Wood County Magistrate Court, Case No. 17-M54C-00237, styled Piferás Service Center, Plaintiff v. Joshua Clay Smith, Defendant, which seeks damages in the amount of $ 3,192.27 and costs of the action inclusive of fees incident to service of process otherwise judgment by default will be rendered against Defendant Joshua Clay Smith at any time thereafter. A true copy of the Civil Complaint may be obtained from the Magistrate Court Clerk of Wood Countyás office.
