ORDER OF PUBLICATION
To: The above named Defendants, their unknown heirs, creditors, successors or assigns, if any.
The object of the above entitled action is to seek interpleader and permission to pay into Court certain insurance policy bodily injury coverage limits proceeds, pursuant to Rule 67 of the West Virginia Rules of Civil Procedure, which interpleader and payment arise out of an automobile collision which occurred on or about January 6, 2016 on or near Murdoch Avenue in the City of Parkersburg, Wood County, West Virginia. The action further seeks a determination by the Court as to the fair and equitable distribution of the sums to be interplead and paid among the Defendants, each of whom may be entitled to receive a portion of the subject insurance policy proceeds.
It appearing by affidavit filed in this action that the whereabouts of the above named Defendants, and their unknown heirs, creditors, successors or assigns, if any, are unknown and/or that such individuals or entities are nonresidents of the State of West Virginia; that there are Defendants whose names are unknown to Plaintiff, and who are made parties to the Complaint filed in this action by the general description of unknown Defendants, and the Plaintiff having made diligent but futile efforts to locate some or all of said Defendants; it is accordingly ORDERED that each of them do appear and serve upon William Crichton VI, Lawyer, whose address is 325 9th Street, Parkersburg, West Virginia, 26101, an answer or other defense to the Petition filed in this action on or before the 1st day of August, 2017.
A copy of said Complaint can be obtained from the undersigned Clerk at her office located in the Wood County Judicial Annex, 2 Government Square, Parkersburg, Wood County, West Virginia 26101.
The names of the Plaintiff and the Defendants, as they are known to be by the exercise of reasonable diligence by the Plaintiff, are as set forth above in the caption of this civil action. The last known address for Plaintiff is c/o William Crichton VI, Esq., 325 9th St., Parkersburg WV 26101. Plaintiff, upon diligent inquiry and investigation, is not aware of the last known address of the Defendants, other than those whose addresses are set forth in the Complaint.
